身心障礙者獲得司法正義 - 嘗試與實踐 (Zoom綫上講座系列)
People with disabilities are often denied equal rights. They further suffer from social and
economic marginalization, poor health, limited
educational opportunities, and rejection from
community participation. Access to justice is limited, further limiting their
ability to obtain redress or defend their rights through legal methods. While the United Nations
Convention on the Rights of Persons with Disabilities (CRPD) is widely
promoted, implementation of convention rights in certain communities remains a
difficult challenge.
身心障礙者面對不平等的人權。他們被社會和經濟邊緣化、健康狀況較差、受教育機會較少、就業機會有限以及社區參與受到各種限制或排斥。他們的基本人權沒有得到充分保障,而訴諸司法正義的障礙進一步限制了他們獲得補救或使用法律方法捍衛自己權利的能力。《聯合國殘疾人權利公約》(CRPD) 得到大力宣傳,但在某些社區難以實施。
The series of seminars discuss
different themes pertaining to their challenges to access justice, including
their rights in court proceedings (especially where they are defendants); their
redress through human rights (where they are claimants); assistance through
communication and information technology (CIT) and other innovations; their
legal capacity and decision making; and the creation of a legal environment
conducive to their access to justice through law reforms.
本系列講座希望從不同角度討論身心障礙者訴諸司法正義的機會,包括: 在司法程式中(當身心障礙者作為被告時);爭取人權過程中(當身心障礙者作為原告挑戰制度不公或者訴訟侵犯權力者);透過通信、資訊技術和創新説明身心障礙者訴諸司法公正;醫學倫理——保護決策權的博弈;身心障礙者訴諸司法正義所必需的法律環境與改革等。
