Program Terms and Conditions for the Volunteer Program and Fountain Heights Farms

By registering to volunteer, I have agreed to perform voluntary services for Fountain Heights Farms & Fountain Heights Cooperative, LLC (FHF) with the understanding that potential risk may be involved. I expressly assume the risk of injury or harm from my activities as a volunteer. I understand that I am free to refuse participation in or to refuse to continue with any activities if I feel my personal safety is in jeopardy. I agree to notify Fountain Heights Farms staff of any hazardous situation I encounter.

I hereby release and agree to hold harmless Fountain Heights Farms & Fountain Heights Cooperative, LLC (FHF), its officers, directors, and employees of and from any and all liability arising from or in connection with my volunteer services to FHF including liability for injury, illness, death or property damage. Further I understand that FHF does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of my injury, illness, death or damage to my property.

This Agreement is intended to be as broad and inclusive as is permitted by law. If any
provision of this Agreement is held to be invalid or legally unenforceable for any reason,
the remainder shall remain valid and fully enforceable. To the fullest extent allowed by law,
I agree to WAIVE, DISCHARGE, RELEASE FROM LIABILITY AND COVENANT NOT TO
SUE Fountain Heights Farms & Fountain Heights Cooperative, LLC (FHF) , its officers, directors, employees, agents, and leaders from any and all liability on account of, or in any way resulting from injuries and damages in any way connected with this activity at the Farm. I further agree to HOLD HARMLESS Fountain Heights Farms & Fountain Heights Cooperative, LLC (FHF) , its officers, directors, employees, agents, and leaders from any claims, damages, injuries or losses caused by my own acts and omissions, including but not limited to negligence while a participant at the Farm. I understand that this assumption of risk and release is binding upon my heirs, executors, administrators and assigns, and includes any minors accompanying me to the Farm.

Volunteer will make no monetary or other claim against Fountain Heights Farms & Fountain Heights Cooperative, LLC (FHF) for the use of the photographs and/or video. *
