AGREEMENT
1. The undersigned recognizes and acknowledges that a. All canines have a propensity to bite other animals and humans, and b. If the Released persons were subject to liability, the cost of covering the risk could be so great as to make canine obedience training classes impracticable. 2. Release, Covenant Not to Sue. Therefore, in exchange for being allowed to participate in canine obedience classes sponsored by the Mississinewa Valley Obedience Training Club, the undersigned does hereby release from liability for harm to me, my family, or my property, and promise not to sue, and the Released Person, which includes the Mississinewa Valley Obedience Training Club, any member of the Mississinewa Valley Obedience Training Club, the sponsors, organizers, planners, or agents of Mississinewa Valley Obedience Training Club, and persons supervising classes. 3. Photography and Video Release. By signing this form, you agree to give Mississinewa Valley Obedience Training Club permission to take photographs and video for publicity and promotional purposes. Your name and likeness will not be sold or used for other purposes other than publicity and promotional purposes. 4. Liability for Attorney Fees. If, despite this agreement, I do sue a Released Person, I agree to pay all costs and expenses (including actual attorney fees) incurred by the Released Person in defending the suit. 5. Exception. I do not release from liability, nor do I promise not to sue, a person who harms me or my property intending that harm, or with actual knowledge that the specific harm was certain to result. 6. Hold Harmless Agreement. If a person other than myself (for example, by spouse, children, relative, or a person who was not released under paragraph 4) asserts a claim against a Released Person arising out of harm to me or my property, I promise to pay whatever amounts (including damages, costs, and actual attorney fees) the Released Person incurs because of the claim. 7. Severability Clause. I have read, understand, and agree to be bound by all of this document. Nevertheless, if any part of it is found unenforceable, I agree to be bound by the remaining parts.
