I. Pre-Trial Practice: Misdemeanor Sexual Assault Case Study: What you need to know from A to Z
Presenter: Aubrey Dillon, Staff Attorney, Trial Division, PDS

The presenter will use a misdemeanor sexual assault case example to cover litigation, discovery, and investigation strategies.   Special attention will be given to motions practice, including issues surrounding immigration, the interpreter act, evidence blocking, and subpoena authority when serving beyond the 25-mile jurisdiction limit.  This session will provide practice tips and sample pleadings and discuss issues relating to the forensic interviews, CFSA, and impediments to obtaining institutional mental health and school records.

II.    JURY INSTRUCTIONS: TRYING A SELF-DEFENSE CASE 
Presenters:  Rachel Cicurel, Staff Attorney, Trial Division, PDS
                      Dan Gonen, Staff Attorney, Trial Division, PDS 
                     
This session will discuss proposed jury instructions in a self-defense case, including Lalchan v. United States, the DCCA’s most recent decision requiring a special self-defense instruction when the evidence shows that the defendant suffered from past intimate-partner violence. The discussion will include tips on preparing proposed instructions to increase a positive outcome for your client in a self-defense case and avoiding improper drafting of jury instructions that can severely undermine your client’s likelihood of success. The discussion will also include a review of the red-book instructions relating to when the use of force is reasonable, the use of deadly versus nondeadly force and imperfect self-defense claims when your client may be the initial aggressor.
