PAYMENT

Consortium Members will each pay a buy-in fee of $250 for professionals (or $100 for students), split in two payments, 1⁄2 to be paid upfront, and the other 1⁄2 upon delivery of the final score. The student fee will apply to any Consortium Member making progress towards an academic degree, certificate, or diploma as of the Due Date. This buy-in fee will be due to the Composer via online purchase, PayPal (also payable by credit/debit card).

PERFORMANCE RIGHTS

Consortium Leader will have the sole right to record and/or perform the Work for two (2) months following the Due Date (March 1, 2023). After this, beginning May 1, 2023, all other Consortium Members will have exclusive performance/recording rights until May 1, 2024. (Note: Consortium Members are not contractually required to perform the work as part of this agreement.)

ADDITIONAL RIGHTS/PROVISIONS

A. The composer grants all Consortium Members the following rights:

The right to create a non-commercial audio/video recording of the Work (provided that a copy of the recording is made available to Composer)
The right to use Composer’s name and likeness in media materials surrounding performances of the Work

B. Consortium Members agree to provide Composer with the following:

A digital scan of the concert program for any public performance of the Work
The right to use the Consortium Members’ names and likeness in media materials for Composer’s marketing purposes
The right to publish or seek publication of the Work following the exclusivity period

COPYRIGHT

All parties attest that Composer is not an employee of Consortium Members; thus Composer retains the copyright of the Work and all other rights associated with the Work not mentioned herein; and that this agreement is not “work made for hire” as determined by the United States Copyright Act of 1976.
