Agreement for Use of L’Engle Instruments and Accessories for Promotional Offer I. Purpose of this Agreement

I. Purpose of this Agreement

This Agreement governs the use and care of L’Engle stringed instruments and related accessories as described herein, which comprise an “Instrument Package” being borrowed.

II. Parties to this Agreement

It is understood and agreed, that while an Instrument Package may be for use by a minor, the Applicant (You) must be age 21 or older and will be responsible for the fulfillment of all the terms of this Agreement. You are the Borrower under this Agreement.

III. Period of this Agreement

Except as otherwise provided, the loan period is for a year which begins with the date that an Instrument Package is picked up and terminates at the earlier of

A. return of the Instrument Package and satisfaction of any charges due to L’Engle
B. at midnight 365 days after acceptance of the package provided no charges are due to L’Engle.
If there is an issue with the condition of any item in the Instrument Package upon expiration of the 365 day loan, the loan period and your responsibility for the package contents continues until all issues are resolved and any and all charges are paid in full. You must provide Information for a credit card which may be used for payment of any charges for repairing or replacing any loss incurred beyond normal wear and tear to the Instrument Package. You will be informed as to the amount of any charges to your card that are to be made. (see Paragraph IX below)

IV. New Agreement After Termination of this Agreement

If use of an Instrument Package is desired upon termination of this Agreement, a new online application must be submitted. Any new Agreement will be subject to the terms and conditions then in effect.

V. Appointment Cancellation Policy

If you cancel your appointment or simply do not keep your appointment to take delivery of an Instrument Package, your use of any L’Engle Instrument may be restricted in the future. If you can not, personally, take delivery of an Instrument Package, you must contact L’Engle at least a week in advance, to make alternative arrangements for delivery and

a. provide the name, address, and contact information of the person who is to keep the appointment for you
b. arrange for valid government issued identification for that person, which is acceptable to L’Engle, to be furnished to L’Engle.

You remain responsible for any Instrument Package accepted by that person on your behalf.

VI. Contents of an Instrument Package

Each Instrument Package consists, at a minimum, of

(1) the musical instrument specified in the application,
(2) the bow for use in playing the instrument,
(3) the case in which the instrument and bow are to be stored,
(4) a tin of rosin for use on the bow,
(5) a soft cloth for keeping the instrument clean,
(6) a card with instructions for use and care of the instrument and its accessories, as well as instructions for contacting L’Engle should there be any damage to, or loss of, any of the contents of an Instrument Package covered by this Agreement. DO NOT attempt to repair or replace an instrument. In addition to incurring fees and costs, you will be disqualified from a future loan.

VII. Replacement Package

If, for any reason, work on any item in an Instrument Package covered by this Agreement is required, L’Engle may, at its option, provide you with a new Instrument Package upon payment of a $15 processing fee for each such package provided that any other charges due have been paid,

VIII. Right to Inspect, Repair, or Replace and Any Cost Involved

L’Engle reserves the right to inspect an Instrument Package at any time. After an instrument Package is returned to L’Engle, it has been inspected, and the cost of repairing any damage or replacing any lost item or part has been determined, you will be given details of the cost of the items involved, including any repair. You will be notified of these costs to be charged against your credit card on file. If for some reason the charges are not approved to be paid by that card, you must make other arrangements to pay the charges in full. Interest and processing fees if any may be charged until the outstanding amount is paid in full. IMPORTANT It is your responsibility to notify L’Engle of any change in the credit card to be used for paying for any charges assessed by L’Engle. L’Engle reserves the right to refuse a future loan to any Applicant.

IX. Agreement Acceptance

If L’Engle determines that an Instrument Package including its accessories is not in the same condition, normal wear and tear excepted, as when it was delivered, then you are financially responsible for the cost of restoring said Instrument Package to its condition when accepted by you. This Agreement does not terminate until an instrument package is returned, and all charges, if any, for that package are paid. You will be provided details as to any charges assessed before the charges are processed on your credit card on file. If, for any reason, the amount outstanding is not paid within 30 days of the date that the charge is to be processed, interest and processing fees may be added to the amount due. Any amount due must be paid before L’Engle will enter into any future Agreement with you.
