I/We, the undersigned parents, or legal guardians of (“Child”) hereby consent to the Child’s enrollment in the Jim McLean Golf School Junior Program (“Program”) to be held at the The Biltmore Hotel (“Club”), and acknowledge and agree as follows:

1. I/We understand that the Child will participate in a number of sports activities including without limitation, golf, tennis and swimming while attending the Program. I/We understand that these activities will involve physical exertion by the Child as well as contact with other children attending the Program, and that many of the activities will take place outdoors.

2. I/We understand that all possible precautions are taken to assure that the activities of the Program are conducted by mature and qualified personnel in a safe and responsible manner. However, because of the nature of some activities, I/We understand that there is a potential risk for bodily injury, property damage and/or death occurring to the Child arising either directly or indirectly out of the Child’s participation in the Program. I/We do recognize these risks and allow the Child to participate in the activities of the Program, and, as a material inducement to the Club, the Club owner The Biltmore Hotel and Jim McLean Enterprises, Inc. to allow the Child’s participation in the Program, I/We hereby release and agree to hold harmless Club, The Biltmore Hotel and Jim McLean Enterprises, Inc. and all successors, assigns, affiliates, partners, co-ventures, shareholders, directors, officers and employees of the foregoing (all the foregoing are hereinafter referred to as “Sponsors”), from and against any and all manner of actions, causes of action, liabilities, controversies, agreements, promises, damages, rights, injuries, judgments, executions, claims and demands of any nature whatsoever at law or in equity, that I/We and/or the Child may have now or in the future, for or by reason of the Child’s participation in the Program, including without limitation, claims or liabilities asserted for the Child’s injuries while participating in any act during said Program, unless such injury is directly caused by the gross negligence of Sponsors or the gross negligence of any employee of Sponsors acting within the scope of such employee’s authority.

3. I/We the undersigned, agree to save, defend, indemnify and hold Sponsors harmless, from and against any and all manner of actions, causes of action, liabilities, controversies, agreements, promises, damages, injuries, rights, judgments, executions, claims, and demands of any nature whatsoever, at law or in equity, that are or may be asserted, entered or claimed against Sponsors or any of them, by any person or entity, for or by reason of the Child’s acts, negligence, willful misconduct or omissions to act, while attending the Program or participating in any activities as part of the Program.

4. The undersigned are not aware of any behavioral or psychological problems, or medical or physical limitations, of the Child which would create a risk of injury or illness to the Child or any other person if the Child participates in the Program.

5. In case of emergency, Sponsors are authorized to seek medical treatment and transportation for the Child using such physicians, hospitals and ambulance services as may be chosen by them in their reasonable discretion.

6. I/We understand that lunch and snacks may/may not provided to the Child while in attendance of the Program.

7. I/We agree and acknowledge that either one of the parents or guardians of the Child listed below will have the authority to remove the Child from the Program. The Program will not be held liable for damages associated with transporting the Child to, from, or during the Junior Program.

8. I/We approve of the publication of any photos taken of the Child while in attendance of the Program.

9. I/We understand that all personal effects, jewelry and any other personal property owned, controlled or used by Child and brought to the Program shall remain the sole responsibility of Child and the undersigned parent(s) or guardian(s) to properly secure from theft, damage or other loss, and I/We agree and acknowledge that Sponsors shall have no obligation or duty for same.

10. I/WE EXPRESSLY ACKNOWLEDGE AND AGREE THAT ACTIVITIES, LESSONS AND/OR PROGRAMS WHICH INVOLVE GOLF, SWIMMING AND PHYSICAL EXERCISE ASSOCIATED WITH PARTICIPATION IN ANY AND ALL SUCH LESSONS AND/OR PROGRAMS MAY INVOLVE THE RISK OF SERIOUS INJURY AND/OR DEATH. I/WE ALSO EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE SPONSORS HAVE MADE NO REPRESENTATIONS OR STATEMENTS OF ANY KIND WHATSOEVER CONCERNING THE CHARACTER AND NATURE OF THE PROGRAM. I/WE ALSO EXPRESSLY ACKNOWLEDGE AND AGREE THAT WE HAVE BEEN TOLD BY THE SPONSORS PRIOR TO PARTICIPATING IN ANY SUCH PROGRAM, THAT THE CHILD OR ANY PERSON WHO ENGAGES IN A PROGRAM OF PHYSICAL EXERCISE SHOULD DO SO ONLY AFTER CONSULTING A PHYSICIAN. THE SPONSORS HAVE NO OBLIGATION OR DUTY TO ASSESS OR INQUIRE INTO THE HEALTH OR PHYSICAL LIMITATIONS OF THE CHILD OR ANY PERSON ATTENDING THE PROGRAM.
