FOR: Recreational Activities hosted, promoted, or organized by Safe Software Inc. (“Safe”) in association with the FME User Conference (the “FME UC”) from August 22 to August 27, 2022.

IMPORTANT INFORMATION

Safe is hosting, promoting and/or organizing several optional, recreation activities (the "ACTIVITIES") during the FME UC for interested participants. These optional activities may include yoga, running, soccer, and other physical or high-risk activities. Safe holds the safety of all participants in high regard. However, participants in the ACTIVITIES must recognize that there is an inherent risk of injury with some of these ACTIVITIES.

You are solely responsible for determining if you are physically fit, suitably skilled, and willing to participate in the ACTIVITIES. Participation in the ACTIVITIES is completely voluntary and in your sole discretion.
Please read this agreement carefully and be aware that by participating in the ACTIVITIES, you will be expressly assuming the risk and legal liability and waiving and releasing all claims for injuries, damages or loss which you might sustain as a result of your participation in the ACTIVITIES.

ASSUMPTION OF RISK, WAIVER, RELEASE, AND INDEMNITY

I recognize and acknowledge that there are certain risks of physical and mental injury relating to participation in the ACTIVITIES, and I voluntarily agree to assume the full risk of any and all injuries, damages, or loss, regardless of severity, that I may sustain as a result of my participation.

I further agree to waive and relinquish all claims I may have (or that accrue to me) as a result of my participation in the ACTIVITES against Safe, including its directors, officers, agents, contractors, representatives, employees, successors and assigns (collectively, Safe’s ”Agents”). I do hereby fully release and forever discharge Safe and its Agents from any and all claims for injuries, damages, or loss that I may have or which may accrue to me arising out of, connected with, or in any way associated with my participation in the ACTIVITIES whether or not such claims arise from the negligence, omission, or willful action of Safe or its Agents. I further agree to indemnify Safe and its Agents against all liability incurred by any of them resulting from my participation in the ACTIVITIES.

This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.
