2023 Marion Tailgate Vendor Application      
Hello!  Thank you for your interest in selling at the Marion Tailgate Market! 
 
Our market currently operates every Saturday beginning May 6th from 10 AM until 2 PM through September with some October dates. There is no Market on Saturday September 16 or October 14. The market is located in downtown Marion under a covered pavilion with electric outlet. The address is 67 W Henderson St.  Marion. Vendors must arrive between 9:00 AM- 9 :30 AM and MUST BE SET UP BY 9:45 AM, unless approval has been given otherwise.  The market is on City property, and per city ordinance, no one (including vendors) is allowed to drive through the tailgate market space during market hours.

We welcome all vendors who are interested to complete this application, please provide as much information as possible about your product offerings. The Market Manager will be in touch with you within 1-2 weeks of receiving your application. You can follow up on your application by emailing grace@foothillsfoodhub.org.

We are a local market, and locally produced items only are permitted. In an effort to strengthen McDowell County's local food economy and the health of our community, we maintain a balance of food and craft vendors. 

The Marion Tailgate Market accepts EBT, Credit, and Debit Cards. McDowell LFAC sponsors the Fresh Bucks program this year, which matches EBT dollars up to $20. Market Vendors selling fresh food and non-hot prepared foods are required to accept EBT tokens for payment. You will be reimbursed by the Market Manager at the end of market for all tokens accepted as payment for your product. 

Vendor Fees are $15/day or $50/season. You can make your payment at https://foothillsfoodhub.org/.  or mail your check payable to McDowell LFAC to McDowell LFAC Attn Marion Tailgate Market PO Box 851, Nebo, NC 28761.

2023 Market Agreement - Please read carefully!  

MADE AND GROWN LOCALLY I certify that the produce/products I sell are grown or made by me. Items I resell must be approved by the Market Manager prior to selling at the Market.

I AGREE TO THE FOLLOWING RULES I, the undersigned, have read the rules governing the Historic Marion Tailgate Market and agree to comply with all the afore mentioned rules and member responsibilities. Violations of the rules and responsibilities give the management the power to revoke my privileges to sell and end my membership with the Market.  I also agree the Tailgate Market Manager can deny any application or cancel any agreement as deemed necessary.                           

WAIVER OF LIABILITY I will not hold the McDowell Local Food Advisory Council or City of Marion, its employees, or the Market management, responsible in the event of an accident in connection with the operation or while on the premises of the Historic Marion Tailgate Market.

Other: I also agree NOT to hold Market (Market members, employees, and volunteers) responsible, or liable, for any damage or loss incurred while at the market. This includes personal injury, theft, and property damage. Collecting and reporting applicable sales tax my responsibility as the vendor. Complaints are filed with the Market Manager. I understand and agree that if excessive complaints are received and it results in the Market Manager asking a vendor to leave the grounds immediately, I will comply without incident. I further give permission to the McDowell LFAC and partners permission to use photos and videos of me, those who sell for me, and products, for marketing purposes.

I also understand that for regular season vendors, spots will be assigned prior to May 2nd.  I agree to notify the market manager as soon as possible if I am unable to attend the market to ensure I keep my assigned spot.  Should I be a no show for 2 days, I will lose my assigned spot.  I am still welcome at the market but a covered (or any) spot may not be available going forward.  If I am a new vendor, farm visits will be required if I choose to sell products I grow.  Additional documentation may be required if I choose to sell crafts or other non-food items.  The Foothills Food Hub manager will be in touch to schedule the farm visit if applicable.  I will be expected to price my farm produced products at or above 80% of regional prices.  I will reach out to the market manager with questions prior to market dates.  I will be required to leave my sales area as clean as I found it.  


Reminder Market vendors must be in place Tuesday by 2:45 PM by 9:45 AM Saturdays.  Market huddles will take place every market day 15 minutes prior to Market opening.
