CGRS announces the release of a new practice advisory, entitled “Restrictions on Employment Authorization for Asylum Seekers: Frequently Asked Questions.”

On June 26, 2020, USCIS finalized a rule that will severely curtail employment authorization eligibility for numerous asylum seekers when it goes into effect on August 25, 2020. However, the rule is complex and each of its provisions include distinct limitations and exceptions. This resource supplements CGRS’s July 2020 practice advisory, “Restrictions on Employment Authorization for Asylum Seekers: Overview of USCIS’s July 26, 2020 Final Rule,” and responds to frequently asked questions (FAQs) that CGRS received from participants during its July 23, 2020 webinar on the new rule, as well as other advocates. The FAQs relate to: (1) the general scope of the rule; (2) the expanded 365-day waiting period for initial EADs and the impact of applicant-caused delays; and (3) new bars to initial and renewal EAD eligibility.
