INCREASING CHALLENGES WITH LABOR LAWS AT WORKPLACE: 

HR professionals and every manager who is leading a team have to deal with labor laws all the time. They are the first line of defense when it comes to labor and employment laws. Lawyers get involved much later when there is limited room for maneuvers. In reality, the destiny of most labor and employment law disputes, as well as compliance, strategy as well as procedures and documentation are decided by HR professionals and team leaders.

In the past, while Bangladesh had many labor laws, most of their impact was on the factories and different manufacturing facilities alone and even their enforcement was rather lax. Focus used to be on managing inspections by labor officials and basic compliance. Corporate offices and other non-manufacturing establishments mostly remained outside the purview of labor law related inspections. Litigation or arbitration between employers and employees used to be very rare in the private sector.

All that has rapidly changed in the last two decade or so. When Bangladesh Labor Act 2006 was introduced, it repealed 25 different laws that were previously in force and then in 2015, Bangladesh Labor Rules 2015 came in to force. While these new laws and rules gave clarity to many issues, they also created new complexities. The scope of labor inspection has also expanded manifold. Corporate offices and non-manufacturing facilities are no more immune to questioning from labor officials.

In this changing context, it has become imperative for all managers and HR, admin and compliance professionals to understand the intricacies of labor laws and rules and their implications to respective teams and workplaces. HR professionals and mangers with good knowledge on labor law make them indispensable to higher management. Those HR professionals and managers also make better decisions, frame better policies and deal with external agencies much better.

PRACTICAL “REAL-WORLD” TRAINING

This course has been designed and gradually modified by incorporating our knowledge and experiences gathered through interacting and resolving many labor and employment law related situations that have been faced by organizations of different sizes and industries across the country. LEARNING OBJECTIVES

At the end of this two-day workshop, the participants should be able to:

  • Gain clarity about the fundamental issues and terms of labor laws and rules, including clarification on different definitions. Particularly who is a “worker” and who is NOT a “worker” in light of our labor law
  • Learn about various rights, duties and responsibilities of workers and employers have towards each other
  • Formulate HR policies that will be more consistent with the labor laws and contribute to enhance workplace harmony and thereby help business growth.
  • Identify any real or potential miss conduct (as per labor law) at workplace and be able to conduct an "end to end" internal disciplinary procedure with full compliance to the due process and documentation requirements
*SHRM certified professionals will also earn 12 PDCs towards their next RECERTTIFICATION

This is a blended workshop (16 hours of both online & in-person classes) that will be conducted in two parts:

  • PART A:  FIVE online classes (2 hours each 8:00 - 10:00 PM) on review of labor law and rules. Dates: February 7, 9, 11, 13 & 15, 2024
  • PART B: Day-long session on "Disciplinary Procedure" on Saturday, February 17, 2024. Time 9:00 PM - 6:00 PM.
  • Venue of Part B: BRAC Learning Center - Gulshan, House: 96 & 98, Road No:10/2, Block D, Dhaka 1212
  • Course Books: One BLA 2006 & one BLL 2015 book will be provided to each participant
  • Course Ending Certificate:  Shall be provided
  • Food: There will be arrangement for breakfast, lunch, morning and afternoon tea

TRAINING METHODOLOGY

In-Person Class

Participants will practically draft show cause notice, conduct mock-inquiry session, record evidence, prepare inquiry report based on collected evidence and also have a set of sample internal letters  that are required for this process.

Muhammad Habibur Rahman 

Acting Labor Advisor  

Bangladesh Employers’ Federation (BEF)


Muhammad Habibur Rahman is currently working as the Acting Labor Advisor of Bangladesh Employers’ Federation (BEF). He has been working at BEF for more than 10 years now. Over the years he has been instrumental in leading all the employment laws related affairs on behalf of BEF. He is the “go-to person” at BEF on any complicated employment law related matters from any of the member organization of BEF.


As a professional lawyer, Habibur Rahman is a member of the Bangladesh Bar Council since 2012 and also a member of Dhaka Bar Association. He is currently also a member (employers’ representative) of the First Labor Court, Dhaka. He has also represented and still representing BEF in some of the most talked about law/rules framing national initiatives or committees by the Government. To mention a few:


- Member, Labor Act Amendment Committee (12-Members Working Group and also a member of the 17 Members Core Committee formed by the Ministry of Labor and Employment, in 2022);
- Member, Labor Rules Amendment Committee (6-Members Working Group and also a member of the 12-Members Core Committee formed by the Ministry of Labor and Employment, in progress);
- Member, Tripartite Consultative Council (TCC), a high-powered committee of the Ministry of Labor and Employment to take decision on any labor related issues;
- Directly involved in the framing of Bangladesh Labor Rules, 2015 on behalf of the employers.

Habibur Rahman is an expert training on labor and employment laws related topics. He has been conducting trainings on various subjects like the labor law, labor rules, domestic inquiry and grievance procedure, workplace cooperation, gender equality and diversity, industrial relations, ADR, conflict management, etc.
