By Submitting this form you, the homeowner, understand that this is not a guarantee of materials and you agree to the conditions listed below. Our volunteers will do their best to source materials that match your needs and connect you to those materials as they become available. Although we value being part of your process of recovery, and want to ensure to the best of our ability that you are sourcing the best possible materials, Living Paradigm does not install materials, assume responsibility for the installation of materials provided or provide any warranty of materials. This is a tool for preliminary estimates of material needs and measurements. It is not for construction purposes, verification or certification of needs, measurements, or other sources of aid, and is intended for estimating and sourcing for donation purposes only. Homeowner will need to use the appropriate professionals to verify needs and measurements.

RECIPIENT ASSUMES ALL RISKS ASSOCIATED WITH THE USE OF BUILDING MATERIALS FROM LIVING PARADIGM and THE CITY OF HOUSTON’S REUSE BUILDING MATERIALS WAREHOUSE LOCATED AT 9003 NORTH MAIN STREET, HOUSTON, TEXAS AND AGREES TO AND DOES HEREBY RELEASE LIVING PARADIGM CDC AND THE CITY, ITS AGENTS, EMPLOYEES, OFFICERS AND LEGAL REPRESENTATIVES, INCLUDING VOLUNTEERS, SUCCESSORS OR ASSIGNS (COLLECTIVELY THE "RELEASEES") FROM ALL LIABILITY FOR INJURY, DEATH, DAMAGE OR LOSS TO ANY PERSON OR PROPERTY SUSTAINED IN CONNECTION WITH OR INCIDENTAL TO ACCEPTANCE OR USE OF BUILDING MATERIALS, EVEN IF THE INJURY, DEATH, DAMAGE OR LOSS IS CAUSED BY THE RELEASEES' SOLE OR CONCURRENT NEGLIGENCE AND/OR THE RELEASEES' STRICT PRODUCTS LIABILITY OR STRICT STATUTORY LIABILITY.  RECIPIENT ASSUMES ALL RISKS AND INJURIES TO ANY PERSON OR DAMAGE TO PROPERTY ARISING OUT OF THE USE OF THE BUILDING MATERIALS.

RECIPIENT FURTHER AGREES TO RELEASE, HOLD HARMLESS, AND COVENANTS NOT TO SUE LIVING PARADIGM CDC, THE CITY, THEIR AGENTS, EMPLOYEES, OFFICERS AND LEGAL REPRESENTATIVES, INCLUDING VOLUNTEERS, SUCCESSORS OR ASSIGNS (COLLECTIVELY THE "RELEASEES") FROM THE ABOVE-DESCRIBED CLAIMS, EVEN THOUGH SUCH INJURY TO PERSONS OR DAMAGE TO PROPERTY IS CAUSED, IN WHOLE OR IN PART, BY ANY DEFECT IN OR CONDITION OF THE BUILDING MATERIALS, OR THE PROPERTY IN WHICH THEY ARE INSTALLED OR USED, AND WHETHER OR NOT SUCH DEFECT OR CONDITION IS KNOWN OR SHOULD HAVE BEEN KNOWN TO LIVING PARADIGM OR THE CITY , THEIR AGENTS, EMPLOYEES, OFFICERS AND LEGAL REPRESENTATIVES, INCLUDING VOLUNTEERS, SUCCESSORS OR ASSIGNS, AND WHETHER OR NOT SUCH CLAIMS ARISE FROM NEGLIGENCE ATTRIBUTABLE TO LIVING PARADIGM OR THE CITY  THEIR AGENTS, EMPLOYEES, OFFICERS AND LEGAL REPRESENTATIVES, INCLUDING VOLUNTEERS, SUCCESSORS OR ASSIGNS.

This Photo Release Form is made by and between Homeowner and L I V I N G  P A R A D I G M  C D C  located at 4315 Yale Street , Houston, TX 77018.  
 
This form authorizes Living Paradigm (LP) to use your likeness in a photograph, video or other digital (media) in any and all publications, including grant reports, print or web-based publications to share the mission with other Donor Organizations, Sponsors, Homeowner’s and Families in need.  

This form authorizes LP to copy, edit, enhance, crop, or otherwise alter any media for use in publications. Signing this form also waives any rights for approval or inspection of any media used in publications. Homeowner understands and agrees that all media are the property of LP. Homeowner acknowledges that this Release has been entered into voluntarily, and homeowner is not entitled to any compensation or royalties with respect to Living Paradigm’s use of the Photos. Homeowner agrees to release and forever discharge Living Paradigm (LP) and its affiliates, successors and assigns, officers, employees, representatives, partners, agents and anyone claiming through them, in their individual and/or corporate capacities from any and all claims, liabilities, obligations, promises, agreements, disputes, demands, damages, causes of action of any nature or kind, known or unknown, which Homeowner, and anyone claiming on behalf of Homeowner, may have or claim to have against LP in connection with this Release. This Release shall be binding upon and inure to the benefit of the parties and their respective heirs, administrators, personal representatives, executors, successors and assigns. Homeowner has the authority to consent to the use and publication of the media. If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. This Release constitutes the entire agreement between the parties and supersedes any and all prior oral or written agreements or understandings between the parties concerning the subject matter of this Release. This Release may not be altered, amended or modified, except by a written document signed by both parties. The terms of this Release shall be governed by and construed in accordance with the laws of the State of Texas. Homeowner has carefully read and fully understands all the provisions of this Release and is freely, knowingly and voluntarily entering into this Release.
