Before submitting this form or using your pass, please read and understand the Notice, Warning to Skiers, Assumption of Risk and Photo Agreement and when applicable Rental Agreement/Liability

NOTICE: Skier and ski lift passengers are governed by the New York State Safety in Skiing Code (Article 18, of the NYS General Obligations law). Before accepting this pass or allowing this pass to be affixed to your person, your attention is directed to a posted "WARNING TO SKIERS" which is printed below and where lift passes are purchased. New York Law requires you to seek out, read, review and understand the "Warning to Skiers" before you decide to participate in the sport of skiing or boarding.

WARNING TO SKIERS AND BOARDERS: Downhill skiing and boarding, as in other sports, contains inherent risks, including but not limited to the risk of personal injury, including catastrophic injury or death or property damage, which may be caused by variations in terrain or weather conditions or surface or subsurface snow, ice, bare spots or areas of thin cover, moguls, ruts bumps or other persons using the facilities; or rocks, branches, forest growth, debris, roots, stumps or other natural objects or manmade objects that are incidental to the provision or maintenance of a skiing and boarding facility in New York State. New York State law imposes a duty on you to become apprised of and understand the risks inherent in the sport of skiing and boarding, which are set forth above, so that you may make an informed decision of whether to participate in skiing and boarding notwithstanding the risks. New York also imposes additional duties upon you, which are set forth in the NYS Article 18 Responsibility Code (posted around Brantling) to which you must adhere for the purpose of avoiding injury caused by any of the risks inherent in skiing and boarding. If you are not willing to assume all of these risks and abide by these duties, you must not participate in skiing and boarding at this area.

ASSUMPTION OF RISK AGREEMENT: I have read and understand the NOTICE above. I have read, reviewed and understand the WARNING TO SKIERS printed above. In signing this application and receiving a pass, I signify that I am aware of and understand the risks inherent in the sport of skiing and that I am accountable for my action as set forth on the WARNING TO SKIERS signs. I agree and acknowledge that I have made a voluntary choice to participate in these activities at Brantling with the risk that they present. In consideration of being permitted to participate in a ski or snowboard instructional program at Brantling, I agree to ASSUME ANY AND ALL RISK OF INJURY OR DEATH, which might be associated with, or result from, my participation in these activities. I agree that this acknowledgement shall be for the entire term of the pass received. All program participants must sign this application before it can be processed and the pass distributed.

PHOTO AGREEMENT: Program participant understands and agrees that Brantling may utilize any photograph, videotape, motion picture or recording for any business or other purpose without further release. Any persons wishing not to allow Brantling use of the image must complete a Photo Opt Out form available upon request.

RENTAL AGREEMENT/RELEASE OF LIABILITY: I verify that the personal information (height, weight, age) on this form is correct. If at any time I feel the equipment is not functioning properly, I will stop using it and return it for inspection, repair or adjustment. I understand and agree that skiing, snowboarding and other winter sports are HAZARDOUS activities that INJURIES from various causes are an INHERENT RISK of participating in these activities, and that injury to any or all parts of my body are a COMMON AND ORDINARY OCCURRENCE during these activities. I freely accept and ASSUME ALL RISKS OR INJURY OR DEATH that may occur while using this equipment. ALPINE SYSTEMS: I have confirmed that the visual release indicators on the alpine ski bindings are the same as those designated on this form. I understand alpine ski/boot/binding systems CANNOT RELEASE OR RETAIN in all situations where release or retention may prevent injury and that they therefore CANNOT GUARANTEE MY SAFETY. SNOWBOARDS AND SKI BOARDS: I understand that the binding systems on snowboards and ski boards are NOT INTENDED TO RELEASE in a fall or upon impact. To the fullest extent allowed by law, I agree to RELEASE FROM LIABILITY, and to INDEMNIFY AND HOLD HARMLESS Rossignol Ski Company, Incorporated (ROSSIGNOL), or other manufacturers and distributors of the equipment provided to me under this agreement, any involved winter sport area, shop or service technician, and their owners, agents, employers and employees for any injuries, damages or death related to the use of this equipment. I FURTHER AGREE NOT TO MAKE A CLAIN OR SUE FOR INJURIES OR DAMAGES RELATING TO THE USE OF THIS EQUIPMENT, whether such claim is based on NEGLIGENCE, breach or warranty, product defect or any other theory. I accept this equipment AS IS with no warranties, express or implied. These waivers and obligations extend to my heirs and assigns. THIS DOCUMENT IS A LEGALLY BINDING CONTRACT which supersedes any other agreements or representations by or between the parties. It shall be interpreted to provide as broad and inclusive a release of liability as is legally possible, but is not intended to assert any claims or defenses which are prohibited by law. If any part of this agreement is deemed void or unenforceable, the remainder shall be given full force and effect. The specific rights of the parties under this contract may vary from state to state.

Your electronic signature implies that you have read, understand, and agree to the “Photo Agreement”, “Notice”, “Warning to Skiers and Boarder” and “Assumption of Risk Agreement” and when applicable "Rental Agreement/Release of Liability" and accept the risks inherent in the sport of skiing and boarding, and accept your duties as set forth in the NYS Article 18 Responsibility Code for yourself and/or minor child(ren).
