LIABILITY WAIVER & RELEASE FORM: In performing volunteer community service, I fully understand that there are some type of risks (including serious injury, death, or severe social or economic losses) which may result from the inadvertent action, inaction or negligence of others or me, or the condition of the premises or of any equipment used. I assume this risk as part of the volunteer community service program of which I participate and know that there may be other risks not known or not reasonably foreseen at this time.
In consideration of being permitted to participate in these activities, I expressly and voluntarily assume all risk of property damage, personal injury and/or death during, or which may result from, participation in this volunteer activity.
I hereby release, agree to defend, hold harmless, indemnify and discharge Involved Parties (Rice Street Business Association, Better Block Hawaii, and associated partner sites and organizations) from any and all liability claims, demands or causes of action that we may have for injuries and/or damages arising out of our participation in the stewardship of community gardens/street trees, including but not limited to, losses caused by the passive or active negligence of ourselves and/or the RSBA Released Parties.
I agree that I/we will not sue or make a claim against RSBA Released Parties for any damages and/or other losses sustained as a result of my participation in this volunteer program.
