RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
& MEMBERSHIP CONSENT FOR UNDER 18 YEARS

APPLICATION.This waiver applies to all participants under the Age of Majority in the Province of Ontario, or the province or territory where lacrosse programs are provided by the Association. This waiver applies to the named participant (the "Minor") for which this registration is completed. The named parent/guardian of the Minor being registered confirms full legal responsibility for the decisions of said Minor.

COLLECTIVE.The Ontario Lacrosse Association (the "Association") and its directors, officers, agents, representatives, employees, volunteers, members, participants, players, coaches, officials, spectators, Zones, Technical Support Groups, Associations, Leagues, Clubs, business operators, agents, site property owners, independent contractors, subcontractors, sponsors, successors, and assignees (collectively the "Releasees").

DEFINITIONS.In this Agreement, the term "Lacrosse Programs" shall include all contact and non-contact activities, programs, events, courses, meetings, and services provided, sponsored or organized by the Association and/or its members, including but not limited to: games, tournaments, practices, camps, technical clinics, championships, conditioning programs and/or training, use of strength training and fitness conditioning, equipment, machines and facilities, orientational or instructional sessions or lessons provided by or sanctioned by the Association or its Releasees.

JURISDICTION.This agreement and any rights, duties, obligations between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Ontario, and I agree to attorn solely to the jurisdiction of the Courts of the Province of Ontario. Any litigation involving the parties to this Agreement shall be brought solely within the Province of Ontario and shall be the exclusive jurisdiction of the Courts of the Province of Ontario.

SAFETY.In entering into this Agreement, I am not relying on any oral, visual or written representations or statements made by the Association or its Releasees with respect to the safety of lacrosse programs other than what is set forth in this Agreement.

ASSUMPTION OF RISKS.I am aware that there are inherent and significant risks, dangers and hazards (collectively the "Risks") associated with the participation of Lacrosse Programs. I am aware that those Risks may result in potential for damage, loss, serious physical injury, illness, or death caused by any event or condition where Lacrosse Programs are provided by the Association or its Releasees. Some of these Risks include but are not limited to:

Health. Overexertion, dehydration, fatigue, lack of fitness or conditioning, traumatic injury, bacterial infections, rashes, the transmission of communicable diseases including COVID-19 and its variants, contagion, bacteria, parasites, other organisms or any mutation thereof;Premises. Defective, dangerous or unsafe conditions of the facilities, dangerous, irregular or unsafe conditions of the grass, turf or other playing surfaces, extreme weather conditions, travel to and from the premises;Equipment. Mechanical failure of the equipment, negligent design, manufacture or operation of the equipment, the provision of or failure by the Releasees to provide any warnings, directions, instructions or guidance as to the use of or safe operation of equipment, failure to use or operate the equipment within my own ability;Contact. Falls, collisions with objects, walls, equipment or persons, whether intentional or unintentional, is a common part of Lacrosse Programs;Advice. Negligent advice regarding Lacrosse Programs or services which are offered, operated or sanctioned by the Association or its Releasees;Conduct. The Participant's conduct or the conduct of other participants including any physical altercation between participants;Personal Responsibility. The Participant is obliged to immediately inform the nearest employee or representative of the Association in the case of any pain, discomfort, fatigue, or other symptoms felt or suffered during and immediately following participation in Lacrosse Programs. The Participant is encouraged to stop participation on their own at any time in the case of any pain, discomfort, fatigue or other symptoms are experienced, and may be requested to stop participation by an employee or representative of the Association who observes symptoms of distress or abnormal response.

I freely accept and fully assume all responsibility for all Risks from the Minor's participation in Lacrosse Programs. I agree that, although the Association and its Releasees have taken steps and actions to reduce or minimize the Risks of participation in Lacrosse Programs, it is not possible for the Association and its Releasees to ensure the completely safeguard against Risks to any participants. I accept these Risks and agree to the terms of this waiver, even if the Association or its Releasees are found to be negligent or in breach of any duty of care or any obligation to myself or the Minor through the Minor's participation in Lacrosse Programs. Furthermore, I believe that the Minor is physically, emotionally, and mentally able to participate in Lacrosse Programs, and is doing so voluntarily and willing. I understand that this waiver is binding on myself, the Minor and any legal representative of myself and/or the Minor for all legal purposes.

In consideration of the Association and its Releasees allowing the Minor to participate in Lacrosse Programs, use its equipment and facilities, and provide its lacrosse services and consultation, I hereby agree as follows:

TO WAIVE ANY AND ALL CLAIMSthat I and/or the Minor have or may have in the future against the Association and its Releasees, and to release and forever discharge the Association and its Releasees from any and all liability for any loss, damage, expense, illness, or injury including death that I and/or the Minor may suffer, or that my next-of-kin may suffer as a result of my participation in Lacrosse Programs due to any cause whatsoever, including but not limited to:

Negligence on part of the Association or its Releasees;Breach of contract by the Association or its Releasees;Error in judgement by the Association or its Releasees;Breach of warranty on the part of the Association or its Releasees in respect to the design, manufacture, selection, installation, maintenance or adjustment of equipment;Failure on the part of the Association or its Releasees to safeguard or protect me from the Risks of Lacrosse Programs, some of which are referred to in the Assumption of Risks section of this agreement;Novel Coronavirus (SARS-CoV-2, COVID-19), and its variants, has been declared a worldwide pandemic by the World Health Organization, and is extremely contagious. The Association has published measures in accordance with public health guidance to reduce the spread of COVID-19 and its variants; however, the Association and its Releasees cannot guarantee that participants will not become infected with viruses including COVID-19 or any mutations thereof.

TO HOLD HARMLESS AND INDEMNIFYthe Association and its Releasees from any and all liability of any nature or kind for any loss, damage, expense, illness, or injury including death to any third party resulting from the Minor's participation in or connection to Lacrosse Programs. Despite the Risks of Lacrosse Programs, and with full understanding of such Risks, I wish for the Minor to participate in Lacrosse Programs with the Association and its Releasees, and I freely accept and fully assume that such Risks, dangers, hazards and the possibility of loss, damage, expense, illness, or injury including death resulting therefrom.

RESIDENCE CLAUSE(Where applicable under OLA Regulations). I and/or the Minor have been a resident at the above address, town and province since January 1st of this year. I agree on behalf of the Minor to play for the above club until released. I am aware that if the Minor plays for any other club without a release or permission, he/she is liable to suspension from lacrosse. If the Minor plays for any team or league outside Canada without permission of the OLA and CLA, he/she will be automatically suspended for 12 months commencing on the date of my application for re-instatement. I and/or the Minor agree to abide by all OLA and CLA regulations and rulings.

CODE OF CONDUCT.I and/or the Minor understand that participation by all members and their parents/guardians is governed by the OLA's Bylaws, Rules & Regulations and Operating Policies, which includes a Code of Conduct provision. I and/or the Minor agree to conduct myself/ourselves in accordance with the OLA's Code of Conduct during all sanctioned activities and events.

IMAGE AND LIKENESS RELEASE.I and/or the Minor authorize the Ontario Lacrosse Association to take and publish photography and/or videography of my/our participation in sanctioned activities and events for publicity and promotional purposes.

PRIVACY AND CONFIDENTIALITY.I understand that all information collected during the registration process is protected by the Ontario Lacrosse Association's Information Privacy Policy and Confidentiality Policy. Should I serve in a paid or volunteer role with the Ontario Lacrosse Association which authorizes access to such information, I understand that I am bound by both the Information Privacy Policy and Confidentiality Policy, and that any personal information is provided to me solely for the purpose of discharging my official duties with the Ontario Lacrosse Association.

ELECTRONIC COMMUNICATIONS.I consent to receive emails and other electronic communication from the Ontario Lacrosse Association and/or its member associations.

ROWAN'S LAW.I understand that Rowan's Law (Concussion Safety), 2018 is a legal requirement for my registration and participation of the Minor in programs and services offered by the Ontario Lacrosse Association, and that it is my personal responsibility to review these resources annually.

PARTICIPATION RESTRICTION. Participation by any OLA-registered volunteers, coaches, officials, athletes and/or teams with the Canadian Lacrosse League and/or any of the IIJL/WJLC "World Lacrosse Championship" events, including U16, U18, Junior and/or Junior Women's programs, will result in immediate suspension of OLA membership for the balance of the season and for the entire season following, from all sanctioned Ontario Lacrosse Association, Team Ontario and Team Canada programs and events. All members suspended under this policy are required to reapply to the OLA for future eligibility. Effective on registration, OLA members are hereby notified of this policy and its consequences.

NOTICE OF AMATEUR STATUS.The CLA and OLA agree and confirm that lacrosse in Canada is an amateur sport and that Junior aged players (21 years and under) may not be remunerated for playing lacrosse. Disciplinary action and sanctions apply as per the CLA Operations Manual.

OBLIGATION TO REPORT CRIMINAL CONVICTIONS: All players who are 18 years of age or older as of January 1st of the current year, are required to declare to the Club Privacy Officer if they have been convicted of an indictable offense under the Criminal Code of Canada upon registering for the current year. The OLA will not knowingly offer membership to any person with a record of criminal convictions, or any criminal offense committed against a person under 18 years old or any offense which may pose a risk to the well-being of the Association's vulnerable sector, volunteers and/or staff. Players may appeal a decision related to involvement by following the OLA Appeal Process.

By signing this Agreement and continuing with registration, you agree that you are the parent/guardian of the Minor being registered, that you have had sufficient time to read and understand each term in this Agreement in its entirety, and that you have read this Agreement and agree to be bound by this Agreement in its entirety. Further, you understand membership in the OLA expires December 31st annually.

I declare that all information provided by me to the OLA is complete, factual and accurate. Further, I understand any information provided by me not to be found complete, factual or accurate can result in suspension or ineligibility to participate, for the Minor.
