I understand that there are inherent dangerous risks of injury and/or loss associated with horse related activities, including the risk of accident, serious bodily injury, death, and damage to and loss of personal property. *

I understand that participation in horse related activities includes being present where those activities take place. *

I agree that by my participation in those activities or as the parent or guardian of a minor child participant, I am voluntarily assuming those risks. *

I agree, therefore, to release, hold harmless, and indemnify Frozen Creek Performance Horses (hereinafter, “FCPH”), its owners, operators, employees, and agents from all claims for money damages or otherwise for any harm to me, any minor child of which I am the parent or guardian, or any horses owned or leased by me, even if the harm resulted, directly or indirectly from the negligence of FCPH, its owners, operators, employees, or agents. *

I further agree that EXCEPT in the event of FCPH's gross and willful negligence, I shall bring no claims, demands, actions and causes of action, and/or litigation against FCPH and/or its associates as stated above for any economic and/or non-economic losses due to bodily injury, death, or property damage, sustained by me and/or my minor child or legal ward and in relation to operation of FCPH to include, riding, handling, grooming, transporting, or otherwise being near horses owned by or in the care, custody, and/or control of FCPH. *

I further agree, therefore, to release, hold harmless, and indemnify Property Owners and any/all of their family, operators, employees, and agents (hereinafter, “PO") from all claims for money damages or otherwise for any harm to me, any minor child of which I am the parent or guardian, or any horses owned or leased by me, even if the harm resulted, directly or indirectly from the negligence of FCPH or PO. *

I further agree that I shall bring no claims, demands, actions and causes of action, and/or litigation against PO as stated above for any economic and/or non-economic losses due to bodily injury, death, or property damage, sustained by me and/or my minor child or legal ward in relation to the premises and any activities performed at the FCPH premises, to include but not limited to, riding, handling, or otherwise being near horses or any other animals, participating in lessons, camps, parties, or any other activity on the premises. *

Warning: Pursuant to ORS 30.691, under Oregon law an equine activity sponsor or equine profession is not liable for an injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. Furthermore, all activities on, at or performed under the guidance of Frozen Creek Performance Horses or PO arise from and are therefore considered equine activities. *
