The participant agrees, while participating in the event, to follow all COVID-19 safety protocols implemented by state and/or local governments, including (but not limited to) Dane County and Madison Public Health Emergency Order #15 (“Order #15”), available at

Some of the provisions required by Order #15 applicable to this event include: 1) use of face coverings (while indoors, while in line to go indoors, while in any enclosed space with other people not in one’s immediate family, and outdoors when 6+ feet of physical distance between individuals cannot be followed; 2) restrictions on gatherings (outdoor gatherings must be held in a space to accommodate all individuals maintaining 6+ feet of physical distance between individuals); 3) regulations for sports (no one may participate in the event who is experiencing a fever or other sickness/illness symptoms; all participants must wash hands whenever possible or whenever the situation dictates such action; all participants must follow safe coughing/sneezing practices to prevent the spread of germs to other individuals) Further, in accordance with Order #15, by signing up for this event, all participants are acknowledging awareness and understanding of sections 4.d.i.-iii. of that Order; i.e., all participants acknowledge awareness and understanding of Movin’ Shoes, Inc.’s hygiene policy, cleaning policy, and protective measures policy, as follows: Movin’ Shoes, Inc.’s Hygiene Policy: All group run participants shall: Not participate or come to the event if they have a fever, and each user/participant agrees to check his/her/their own temperature before coming to the event. A fever is defined as 99°F+. Not participate or come to the event if they have any other symptom of a respiratory illness, including, but not limited to, cough, aches, chills, headache, difficulty breathing, running nose/congestion. Wash his/her/their hands before coming to the event. Wash his/her/their hands after using the restroom during the event. Wash his/her/their hands after coming into contact with any other person. Utilize hand sanitizer as supplied by Movin’ Shoes, Inc. at the event. Engage in safe coughing/sneezing etiquette, which includes covering one’s mouth with the inside of the arm and turning one’s head away from other people while coughing or sneezing. Movin’ Shoes, Inc.’s Cleaning Policy: Movin’ Shoes, Inc. shall follow its in-store cleaning procedure as applicable during any group run event. This includes, but is not limited to, cleaning (with disinfecting spray/wipe or other CDC-approved procedure) any surface that could be used by multiple persons in between each person’s use and any object that could be used similarly. Movin’ Shoes, Inc.’s Protective Measures Policy: All participants in the group run shall maintain 6+ feet of physical distance unless actively participating in the sporting activity. All participants shall utilize enough space to permit 6+ feet of physical distance between individuals. Movin’ Shoes, Inc. (“Movin’”) has put in place safety procedures and practices consistent with and pursuant to Order #15 for its group runs. However, Movin’ cannot guarantee that, even if all participants follow all of the provisions of Order #15 or any other applicable state or local ordinance/rule, a participant will not become infected with COVID-19 as a result of participation in a group run. Further, Movin’ does not recommend that any person who falls into any of the foregoing categories participate in any of Movin’s group runs: 1) anyone who has experienced symptoms of COVID-19 in the past 14 days, including cough, fever, shortness of breath, etc.; 2) anyone who has traveled in the last 14 days to another country or to a community experiencing community spread of COVID-19; 3) anyone who believes he/she/they have been exposed to a confirmed or suspected case of COVID-19 or anyone who has been diagnosed with COVID-19 and not yet declared non-contagious by a local health official.The participant agrees to fulfill a duty of self-monitoring and self-compliance, meaning all participants must monitor their own potential symptoms of COVID-19 and comply with all of the expectations contained herein. The participant further agrees that he/she/they derives personal benefit from participating in this event and does so of his/her/their own volition. The participant assumes all risks associated with participation in this event, whether related to COVID-19 or otherwise. Finally, the participant releases, waives and forever discharges any and all liability, claims, and demands of whatever kind or nature against Movin’ Shoes, Inc. and its affiliated partners and sponsors, including in each case, without limitation, the employees, volunteers, and agents, either in law or equity, to the fullest extent permissible by law, including but not limited to damages or losses caused by negligence, fault, or conduct of any kind of any Movin’ Shoes, Inc. employee, volunteer, or agent, including but not limited to death, bodily harm, illness, economic loss, expenses, or damage to property, which the participant, his/her/their heirs, assignees, next of kind, and/or legally appointed designee or representative, may have or which may hereinafter accrue on the participant’s behalf, which arise or may hereafter arise from participation in this event.
