AGREEMENT, RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in or assisting others in participation of the events and activities conducted by YHC (Your Help Counts), on behalf of myself; (1) I ACKNOWLEDGE, UNDERSTAND AND DECLARE THAT: (a) To the best of my knowledge, I am in GOOD PHYSICAL CONDITION and have no disease or injury that would be aggravated by participating in activities related to the Tournament; (b) Participating or assisting others in participating in the Tournament may involve RISK OF INJURY TO ME, INCLUDING DEATH, LOSS OR DAMAGE TO ME OR MY PROPERTY, or other consequences, this might result not only from my own actions, in actions or negligence but also the actions, in actions or negligence of others, the rules play, or the conditions of the premises or of any equipment used; (c) There may be OTHER RISKS not known or not reasonably foreseeable; and Understanding All of the above, (d) NC Park policies, rules & regulations as mentioned in NORTH CARY PARK (e) I will maintain the NC Park property and belongings, if any damages occurred due to my actions, I will be responsible bearing the costs and time to resolve them with the concerned parties directly. (2) I ASSUME ALL OF THE ABOVE RISKS AND RELEASE WAIVE, DISCHARGE, HOLD HARMLESS, INDEMNIFY AND COVENANT NOT TO SUE: (a) YourHelpCounts Charity Tournament, NC Parks & Recreation, North Cary Park, or any of its affiliates, its Board of Directors, its employees, committee members, agents, volunteers, coaches, trainers, or officials affiliated with their programs; (b) Any affiliated subsidiary, organization, or related companies or businesses, other participants, municipalities, governmental agencies, agencies, sponsors, or advertisers, the respective administrators, officers, directors, agents, representatives, employees or volunteers of such entities or organizations; (c) Owners, lessors and lessees of premises used to conduct the Tournament FROM ANY AND ALL LIABILITY FOR INJURY, INCLUDING DEATH, LOSS OR DAMAGE TO PERSON OR PROPERTY, and OR ANY OTHER CONSEQUENCE in connection with entry in or arising out of participation in, performance in or lack of performance in, including travel en route to and from the Tournament. (3) I AGREE THAT: (a) Prior to participating as an athlete, I, will INSPECT the facilities and equipment to be used, and if I believe same to be unsafe, I will immediately REPORT such condition(s) to the supervisor or official connected with the Tournament of same and either DECLINE TO PARTICIPATE or ASSUME THE RISK of participating; (b ) I will keep the North Cary Park clean, will not tamper the park property, keep the restrooms clean, throw trashes into the trash bins. (4) Inappropriate Behavior and Banned Substances: Any behavior that can lead to or can be perceived as leading to emotional, mental, or physical harm in the form of bullying, overtly negative and abusive language, including inappropriate sexual misconduct, language, or unwelcome actions, will NOT be tolerated. If such behavior is reported or observed, the individual will be asked to reconcile the wrongdoing (offer a genuine apology) and be given a strict first offense warning. If the individual is part of a team, the individual’s team will receive a strict verbal warning. If a second incident occurs within the same team, the individuals and team will be asked to leave the physical vicinity of the tournament and will NOT receive a refund for their registration. Teams and the individuals on the teams are fully responsible for their actions, language, and behavior and as such, are encouraged to practice good sportsmanship on and off the field at all times. Alcohol and smoking (e-cigarettes included) are not permitted on the tournament field during any game or within the event vicinity in the park. Offenders to these regulations will be asked to leave the tournament without refund. Playing while intoxicated or under the influence is also strictly prohibited. These regulations are set in place to preserve the integrity, enjoyment, and professional quality of the tournament for all players and attendees, of all ages. Respect and courtesy for fellow players and attendees is expected. (5) I CONSENT TO: (a) ALL EMERGENCY MEDICAL TREATMENT as may be deemed appropriate under existing circumstances by medical personnel or personnel associated with the Tournament. I HAVE READ THIS FORM IN ITS ENTIRITY AND HAVE PROVIDED TRUTHFUL INFORMATION. (b) Follow all rules and procedures of the event/activity and follow the reasonable instructions of the officers, directors, representatives, agents, and volunteers of YourHelpCounts; (c) I will ALLOW my PHOTOGRAPH, PICTURE or LIKENESS and/or VOICE to APPEAR in any official documentary, Promotional (including and all advertisements), television, radio or film coverage of the Tournament, YourHelpCounts Website WITHOUT COMPENSATION. *
