INDEMNITY, WAIVER OF LIABILITY, ASSUMPTION OF RISK, PARTICIPANTS DECLARATION & CONSENT

Allstar Sports Pty Ltd (A.C.N 153 372 779) is a company registered in Australia (Allstar). Allstar organises, administers and/or takes part in events that are functional movement events that require various levels of physical and mental fitness in order for participants in those events to participate in, enjoy, take part in or observe. Allstar is assisted in its business by their officers, employees, servants, sponsors, agents, officials, volunteers and other contestants (Associates)

The events are functional movement events that require its participants to endure physical exertion. The events are held for the purpose of fun, exercise and competition and as such will also require its participants to endure mental exertion. The events are held at numerous venues in Australia and around the World and Allstar does not have complete control of the venue facilities, their location or the condition, maintenance or topography of the venues,

It is a condition of my participation in the event that Allstar and their Associates are absolved from all liability howsoever arising from injury or damage howsoever caused arising out of participating in the event or in any way whatsoever due to any negligent act or breach of duty, default and/or omission on the part of Allstar and their Associates.

In consideration of Allstar and their Associates allowing me, the participant, to participate in, enjoy, take part in or observe the events, I must and hereby do, acknowledge, offer and agree to be bound by the terms and conditions herein and the representations, warranties and acknowledgements I make herein.

1. I warrant that I have full legal and mental capacity to enter into this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent, on my own behalf and on behalf of any other person with whom I am authorised to act on behalf of, as parent, guardian or otherwise.

2. This Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent, shall bind me and my heirs, executors and administrators, irrevocably.

3. I acknowledge and agree that I have engaged in the activities of the event freely, voluntarily and absolutely at my own risk and with a full appreciation of the nature and extent of all risks involved in the event.

4. I warrant and declare that I am in a state of good health and fitness to the levels required to enjoy, take part in or observe the event and do not expect any medical complications to arise from my participation in the event

5. I acknowledge and agree that Allstar and their Associates to do not control the venue or venues in which the events are held and acknowledge and agree that the events may be held over public and private roads or surfaces which will require me to traverse, navigate or confront naturally occurring and/or manmade objects and obstacles, including, but not limited, to gates, uneven surfaces, traffic controls, manholes, potholes, steps, kerbs, trees, branches, cars, bicycles, buses, trams, dogs and other persons.

6. I acknowledge and agree that Allstar and their Associates to do not control the weather conditions in which the events are held and acknowledge and agree that the events may be held in rain, wind, snow, heat or cold, or the events may be subjected to extreme weather events, prior to, during or after the event.

7. I acknowledge and agree that there are inherent risks of accident and/or injury present in all aspects of the event, including but not limited to slips and falls, falling participants or equipment, failure of equipment, sporting injuries including muscle pain, cramps or soreness, abnormal blood pressure, discomfort, heart problems, fatigue, nausea, light-headedness or any other form of physical or mental injury.

8. I acknowledge and agree that should I suffer any injury, accident and/or illness whilst participating in the event I authorise Allstar and their Associates to give, obtain or authorise any medical assistance or treatment including executing permission forms and other necessary medical documents which they may, in their unfettered discretion necessary or expedient and I agree to pay all costs, fees and/or expenses howsoever arising which may be incurred by Allstar and their Associates in so doing

9. I acknowledge and agree that Allstar and their Associates are absolved from all liability howsoever arising from injury or damage howsoever caused arising out of participating in the event or in any way whatsoever due to any negligent act or breach of duty, default and/or omission on the part of Allstar and their Associates.

10. I acknowledge and agree that it would be unreasonable for Allstar and their Associates to be in any way responsible for my injury or death and I hereby, to the full extent permitted by law, waive all of my legal rights of action against and fully release Allstar and their Associates for loss, damages, injury or death howsoever arising out of or in relation to my participation in the events organised by Allstar and their Associates, including without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of Allstar and their Associates.

11. I agree to abide by any reasonable direction given to me by Allstar and their Associates whilst I am participating in the events.

12. I hereby irrevocably grant Allstar and their Associates permission to take still photographs, video and voice recordings of me in conjunction with my participation in the events and grant Allstar and their Associates permission to use such, worldwide and in any form, including edited versions, at their sole discretion and including, without limitation, for any commercial purpose, without compensation or payment to me.

13. I acknowledge that Allstar and their Associates make no guarantees of safety or fitness for purpose, suitability and/or functionality of any venue, equipment or facilities used or available for use in conjunction with any event and Allstar and their Associates and I agree to accept any all risks associated with the use of any venue, equipment or facilities at the events.

14. I acknowledge and agree that this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent may and will be pleaded as a bar to any action arising from participating in the event against Allstar and their Associates.

15. I acknowledge and agree that this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent is governed by the laws of Queensland (Australia)and I irrevocably and unconditionally submit to the exclusive jurisdiction of the Courts of Queensland and any appeal from them.

16. I acknowledge and agree that if it is held by a Court of competent jurisdiction that any part of this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent is void, voidable, illegal or unenforceable; or that it would be void, voidable, illegal or unenforceable unless any part was severed; then that part will be severable from and shall not affect or derogate from the enforceability or validity of my obligations or the continued operation of the rest of this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent.

17. I acknowledge and agree that I will take all steps, execute all documents and do everything reasonably required by Allstar and their Associates to give effect to the terms and conditions herein and the representations, warranties and acknowledgements I make herein.

18. I acknowledge and agree that I allow Revival and/or Mobility MVMNT to send me promotional and marketing information via the email address I supply through this waiver.

19. I acknowledge and agree that I have been allowed the opportunity to obtain independent legal advice in relation to this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent.

20. I acknowledge and agree that, in all the circumstances, this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent is fair and reasonable.

21. I acknowledge and agree that any previous understanding, agreement, explanation or representation made to me is superseded by this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent.

22. I expressly consent to the processing of my personal information for both the event I am entering and for marketing purposes and know & understand that by agreeing to same that I may receive athlete packs, newsletters in the form of emails, sms's and the like for this event and future Allstar Sports products.

I have fully read and understood this Indemnity, Waiver of Liability, Assumption of Risk, Participants Declaration & Consent and hereby accept that I am fully waiving all of my legal rights that I have or may have against Allstar and their Associates in relation to the events and accepting any all risk, danger or hazard of enjoying, taking part in or observing the events.

Allstar Sports Pty Ltd acceptance of the participants Indemnity, waiver of Liability, Assumption of Risk, Participants Declaration & Consent may be by express statement or implied by conduct, such as allowing the participant to participate in an event.
