These terms and conditions refer to the Totti Soccer School and F&C Soccer Evolution Management camps.

Important Information

Please read our Terms and Conditions carefully and make sure you understand them before applying for a place in a camp.

BOOKING TERMS AND CONDITIONS

In these Terms and Conditions: 

"Authorised Adult" means the parent or legal guardian of a Participant.

"Camp" means any residential or day program offered by F&C Soccer Evolution Management.

“Participant” means the person for whom a place has been booked at a Camp.

"Reservation" means a booking made for a Camp.

"Deposit" means any deposit specified or required by us for any Participant for any Camp.

1. Booking and Prices

1.1 After you have reserved a place in a camp, we will send you a 'confirmation e-mail' to confirm that we have processed your application. If you have paid for the camp while registering your application, you will receive an email confirming your payment. All applications are subject to acceptance by F&C Soccer Evolution Management in line with these Terms and Conditions. Your offer is accepted by F&C Soccer Evolution Management and a binding agreement is created between F&C Soccer Evolution Management and you if you have not heard otherwise within 7 days of receipt of your 'order confirmation email'.

 1.2 It is important that you check the details contained in your 'order confirmation email' when you receive it. If you have any questions or if the information is incorrect, please contact F&C Soccer Evolution Management immediately at the e-mail address fecsoccerevolutio.it@yahoo.com.

1.3 Every reservation to a camp must be accompanied by payment of the participation fee before the start of the camp. Places are limited and failure to pay the fee in time may result in the cancellation of the registration.

 1.4 A participant will not be able to attend a camp unless all fees have been paid prior to the start of the camp and F&C Soccer Evolution Management reserves the right to cancel any booking made on behalf of the participant in the event of late payment.

 1.5 Deposit payment is due at the time of booking a place at a Camp. F&C Soccer Evolution Management will only send you an 'order confirmation email' once it has received your completed application and deposit payment (or full payment).

1.6 By reserving a place in a camp you confirm that:

1.6.1 You are legally able to enter into binding contracts;

1.6.2 You are at least 18 years old;

1.6.3 You are booking a camp as an authorised adult.

1.6.4 You are not reserving a place on a pitch that you intend to resell unless you have been authorised to do so by F&C Soccer Evolution Management.

1.6.5 You have read and agreed to the Terms and Conditions set out herein;

1.6.6 the price of the Pitches are set at €. 270 minimum and may change at any time.

1.6.7 You are responsible for organising and paying for the Participant's travel to and from the Camp location.

1.6.8 The Participant is aware that the prices include the applicable Value Added Tax ("VAT"). If the VAT rate changes before the Participant makes any payment, the VAT rate may change the price paid by the Participant.

 1.9 If you are a person or company or organisation authorised by F&C Soccer Evolution Management, you agree to disclose these Terms and Conditions to the Participant's authorised adult, who agrees that these Terms and Conditions shall be binding on him/her as if he/she had requested on behalf of the Participant to reserve a place on a Camp.

 2. Cancellation and Refunds

2.1 How to cancel a Reservation

To cancel a Reservation, the contracting party must inform F&C Soccer Evolution Management by e-mail at fecsoccerevolution.it@yahoo.com. Proof of sending the e-mail is not proof of receipt. If you do not receive a reply within 3 days, you must contact F&C Soccer Evolution Management or one of its employees in the country where the camp/event takes place by phone.

2.2 Our refund policy

 Camp/event bookings:

2.2.1 If you cancel your Reservation within 30 days of making the Reservation, provided that the Camp has not already started or 30 days before it starts, F&C Soccer Evolution Management will provide you with a full refund (including the deposit).

2.2.2 If you cancel your Booking more than 14 days after it has been accepted by F&C Soccer Evolution Management, then

(a) if the cancellation occurs more than 30 days before the first day of the Camp and payment for the Camp has been made in full, F&C Soccer Evolution Management will refund the amount paid for the Camp, less the deposit; or

(b) if you cancel more than 30 days before the first day of the Camp and you have not paid for the Camp in full (for example, if only the deposit has been paid), you will not be required to pay the balance of the Camp, but you will not be entitled to a refund of the deposit; or

(c) if you cancel less than 30 days or less before the first day of the Camp, you will not be entitled to any refund, including the deposit; and

(d) if F&C Soccer Evolution Management does not receive payment of the balance on time, F&C Soccer Evolution Management may cancel the booking and the customer shall not be entitled to any refund. F&C Soccer Evolution Management will inform you of this by e-mail.

 Reservations for day camps:

2.2.3 If you cancel your Booking more than 21 days before the start date of the camp, F&C Soccer Evolution Management will refund the full amount paid for the camp, less a €50 administration fee.

2.2.4 If you cancel your Booking 21 days or less before the start date of the Camp, you will not be entitled to a refund.

 2.3 Cancellation for medical reasons

2.3.1 If the Participant is unable to participate due to illness or injury, F&C Soccer Evolution Management will offer a Voucher for all fees paid, provided that the Participant notifies F&C Soccer Evolution Management of the illness or injury at least 24 hours before the start of the Camp. F&C Soccer Evolution Management will require a letter from the Participant's doctor as proof of illness or injury before issuing the Voucher. This voucher will be valid for any similar booking made at one of our camps in the same or subsequent year (subject to availability). The voucher is transferable to any family member and can be used at any camp offered by F&C Soccer Evolution Management. Please note that the voucher has no monetary value and cannot be exchanged for cash.

2.3.2 Participants who leave the camp early due to illness or injury will receive a voucher with a value proportional to the unused part of the camp. This voucher can be used as credit for a reservation at one of our camps in the same or the following year. The voucher is transferable to any family member and can be used for any camp offered by F&C Soccer Evolution Management.

 2.4 Other terms relating to cancellation

2.4.1 Due to circumstances beyond our control, including insufficient attendance, natural disasters such as flooding, war, security issues or epidemics, F&C Soccer Evolution Management may cancel, move or postpone a Camp. If F&C Soccer Evolution Management postpones or cancels a Camp for any reason, F&C Soccer Evolution Management will provide the Participant with a Voucher for a place at a similar Camp at one of our venues in the same or subsequent year (but the Participant will not be entitled to a cash refund). If F&C Soccer Evolution Management moves a Camp from the advertised venue to another venue and provided that, in our reasonable opinion, the Camp at the new venue is of similar quality to the one at the advertised venue, in the event that you wish to cancel your booking, clause 2.2 of our Refund Policy shall apply.

Cancellation by F&C Soccer Evolution Management (Covid-19)

2.4.2 F&C Soccer Evolution Management has the right to cancel a Camp at any time up to the commencement of the Camp if, in its reasonable judgment, the holding of the Camp is impossible, illegal or materially difficult or if the holding of the Camp is likely to be uneconomic. In the case of a Camp with multiple locations, F&C Soccer Evolution Management may transfer registered players to any of the locations if the number of participants is insufficient to make the Camp at that specific location economically or sportingly viable. F&C Soccer Evolution Management may exercise the right to cancel the Camp if circumstances such as an additional wave of cases, an additional or continuing lockout period, or new or continuing governmental restrictions occur or are reasonable to occur that, in our reasonable opinion, would (a) prevent or restrict travel to the Camp by a significant number of participants; or (b) make it impossible, illegal, or materially difficult to conduct the Camp; or (c) make it uneconomic to conduct the Camp. In the event that F&C Soccer Evolution Management postpones or cancels a Camp for the reasons set out in this clause 2.4.2, F&C Soccer Evolution Management will provide a full refund of all fees paid, provided that the booking was made after 1 September 2020 and the booking was not made with a Voucher from a previous year.

2.5.4 If F&C Soccer Evolution Management moves a Camp from the advertised location to another location and provided that, in our reasonable opinion, the Camp at the new location is of similar quality to the Camp at the advertised location, clause 2.2 of our Refunds Policy shall apply.

2.5.5 In all cases where the user is entitled to receive a refund or voucher, F&C Soccer Evolution Management will process the refund or issue the voucher within 60 days of notification of cancellation. The refunds will be made using the same payment method used by the User.

2.5.6 Please note that if F&C Soccer Evolution Management has issued a Voucher to the User and the User has made a new booking with the Voucher and the Camp for which the User made the new booking has been cancelled for reasons beyond our control in accordance with clause 2.5.2 or 2.5.3, the Voucher will be carried over to a new Camp in the same or the following year.

Cancellation by F&C Soccer Evolution Management due to number of participants

2.5.7 F&C Soccer Evolution Management shall have the right to cancel a Camp at any time up to the commencement of the Camp if, in its reasonable judgement, holding the Camp would be uneconomic due to the number of participants. In this case the participant shall be entitled to a full refund.

3. Physical fitness and risk of injury

3.1 You must ensure that the Participant is physically fit and able to participate in sporting activities. If you need further information about the physical fitness required of Participants or if you have any doubts about whether a Participant is fit enough to participate in a Camp, please contact F&C Soccer Evolution Management before booking a place in a Camp. F&C Soccer Evolution Management will not make any refunds because a Participant is not fit enough to take part in any part of the Camp.

3.2 Please be aware that the physical nature of the Camp always involves the risk of accident and injury. It is your responsibility to ensure that the Participant is in good health and does not have any medical conditions that may pose a risk of injury or physical harm. By making a Reservation, the Participant accepts the risk of reasonably foreseeable injury arising from participation in Camp activities.

3.3 It is your responsibility to notify F&C Soccer Evolution Management if the Participant suffers from any physical or mental condition that may give rise to special needs or affect his or her ability to participate in the Camp. Disclosure of such information will enable F&C Soccer Evolution Management to make any reasonable adjustments that may be necessary to accommodate the Participant's physical or mental needs during the Camp.

3.4 F&C Soccer Evolution Management may request additional information depending on the medical information provided to F&C Soccer Evolution Management prior to the Camp.

 3.5 If a Participant arrives at the Camp with a medical condition that has not been disclosed or incompletely disclosed to F&C Soccer Evolution Management, or if such condition arises during the Camp or if the Participant's medical history has not been sufficiently disclosed to F&C Soccer Evolution Management to enable F&C Soccer Evolution Management to make an informed judgement as to the Participant's fitness to participate in the Camp, F&C Soccer Evolution Management may refuse to accept the Participant to the Camp or require the Participant to leave the Camp, as appropriate.

 4. Medical Assistance

4.1 In the event that the Participant requires medical treatment during the Camp, the Participant agrees that F&C Soccer Evolution Management will arrange for any appropriate and necessary emergency treatment. F&C Soccer Evolution Management will endeavour to contact the emergency contact named on the Booking Form or Player Support Form to obtain the Participant's consent to any decision regarding the organisation of such treatment. However, you agree that in emergency situations F&C Soccer Evolution Management may not be able to contact such a person and may proceed to arrange and consent to such treatment without doing so. In arranging or authorising any treatment, F&C Soccer Evolution Management will take advice from suitably qualified doctors, clinicians and staff and the User agrees that F&C Soccer Evolution Management and they are entitled to assume that the medical information provided by the User is complete, accurate and up to date.

4.2 Please note that in the event of an injury or illness to a child/young person, F&C Soccer Evolution Management may, in some cases, reasonably determine that no medical treatment is necessary or that general first aid is sufficient. In all cases, you acknowledge that F&C Soccer Evolution Management has the right to exercise its reasonable discretion regarding the need for further medical treatment. Provided that F&C Soccer Evolution Management has acted reasonably in all the circumstances (giving due consideration to the symptoms presented by the Participant while in our care), the Participant agrees not to hold F&C Soccer Evolution Management responsible for any decision not to administer or authorise further medical treatment for the Participant. For further information on our liability, please refer to clause 6 below.

 5. Insurance

5.1 It is your responsibility to ensure that the Participant has adequate travel and medical insurance to cover the costs of any necessary medical treatment. The Participant's insurance must also cover any additional costs associated with accommodation, travel, transport and/or repatriation to the Participant's home country. The Participant must bring the medical insurance policy documents with him/her to the camp and provide them to the camp staff at registration.

6. Liability

6.1 F&C Soccer Evolution Management shall be liable to you for foreseeable loss or damage caused by F&C Soccer Evolution Management. If F&C Soccer Evolution Management fails to comply with these Terms and Conditions, F&C Soccer Evolution Management shall only be liable to you for losses or damages suffered by you that are the foreseeable result of your breach of this agreement or our failure to use reasonable care and skill. A loss or damage is foreseeable if it is obvious that it is going to occur or if, at the time of entering into the contract, both F&C Soccer Evolution Management and you knew it was going to happen, for example if you discussed it with F&C Soccer Evolution Management or an F&C Soccer Evolution Management employee or representative during the sales process.

6.2 F&C Soccer Evolution Management is not responsible for:

6.2.1 any loss caused by any breach of our agreement by any person other than F&C Soccer Evolution Management; and

6.2.2 any commercial loss.

6.3 Nothing in this clause excludes or in any way limits our liability to you where it would be unlawful to do so. This includes: liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; fraud or fraudulent misrepresentation; or breach of your statutory rights in relation to the Camp.

6.4 Please note that any travel or participation involves a risk of disease or infection. As such, there is a risk of the Participant contracting Covid-19 (Coronavirus) or another disease as a result of a pandemic, epidemic or continuous transmission of readily communicable diseases.  It is agreed that, provided that F&C Soccer Evolution Management has taken adequate precautions in line with current local authority guidance where the camp/event is held and has not been otherwise negligent, F&C Soccer Evolution Management shall not be liable in the event of infection.

6.5 In the event that an authorised adult removes the Participant from the Camp, such authorised adult shall be responsible for ensuring that the Participant is in possession of any valuables, airline tickets, passport, money or other items that may have been kept by F&C Soccer Evolution Management during the duration of the Camp.

6.6 F&C Soccer Evolution Management accepts no responsibility for personal belongings left with F&C Soccer Evolution Management, including passports, tickets, money and valuables.

6.7 F&C Soccer Evolution Management accepts no responsibility for the Participant's belongings left at the Camp.

6.8 Although F&C Soccer Evolution Management will endeavour to remind all Participants to pack all their personal belongings and to collect their valuables from the Camp Administrator, F&C Soccer Evolution Management accepts no responsibility in the event that a Participant loses or forgets their passport, airline tickets or any other items. Any additional costs incurred by F&C Soccer Evolution Management on behalf of the Participant, including the replacement of the passport, flight tickets or other documentation, will be charged to the Participant.

6.9 In the event that F&C Soccer Evolution Management has reasonable grounds and/or clinical evidence to indicate that the Participant may be suffering from an infectious disease, F&C Soccer Evolution Management may request an Authorised Adult to remove the Participant from the Camp within 24 hours of F&C Soccer Evolution Management notifying the Participant.

 7. Letters of support for the visa

7.1 At the request of the Participant, F&C Soccer Evolution Management may provide a letter of support for obtaining a visa for entry into the country where the Camp is held. Please note, however, that the Participant shall be solely responsible for obtaining a visa for entry into the country where the Camp/Event takes place. For the avoidance of doubt, F&C Soccer Evolution Management does not guarantee in any way that our visa support letter will be granted to the Participant and accepts no liability in the event that the Participant's visa application is refused or the Participant fails to obtain a visa.

7.2 For the avoidance of doubt, F&C Soccer Evolution Management shall not be liable for any further costs other than in accordance with our cancellation and refund policy set out in clause 2 of these Terms and Conditions.

 8 Camp Participants must abide by all camp rules and regulations, such as

8.1 Participants in the Camps must abide by all Camp rules and regulations as specified by F&C Soccer Evolution Management from time to time, including the Camp Code of Conduct ("Camp Rules") which will be provided to all Participants at the start of the Camp. The Camp Rules apply at any location where Camps are held and include any oral or written instructions given by Camp personnel at any location where Camps are held. By making a Booking, you accept and agree that the Camp Rules form part of the agreement between us.

8.2 F&C Soccer Evolution Management considers the safety and welfare of all Participants attending the Camps to be a priority. F&C Soccer Evolution Management therefore reserves the right to remove from the Camps, without refund, any Participant who fails to comply with the Camp Rules. F&C Soccer Evolution Management also reserves the right to remove from its Camps, without any refund, any Participant that F&C Soccer Evolution Management deems to be generally disruptive or behaving in a manner that constitutes a danger or disturbance to others.

8.3 F&C Soccer Evolution Management reserves the right to ask any Participant to leave the Camp who, in our opinion, is physically or mentally unable to participate safely in the Camp.

8.4 If a Participant is removed from a Camp, it is your responsibility to arrange and pay for any travel, accommodation or other expenses incurred.

9. Complaints

9.1 Our goal is to provide you with the best possible Camp experience. However, if you are dissatisfied with something, please inform our Camp staff using the contact numbers provided to resolve the issue.

9.2 When the Participant returns home, if you feel you need to make a formal complaint, please email F&C Soccer Evolution Management within 14 days of the end date of the Camp, using the contact details set out in clause 12.2.

10. Intellectual Property

10.1 The form and content of our marketing materials, including training documents, scripts and other materials and all intellectual property rights in our services that belong to F&C Soccer Evolution Management or our licensors ("Materials") are protected by copyright and other intellectual property rights and all rights are reserved.

10.2 With specific regard to F&C Soccer Evolution Management football camps and Totti Academy camps, the names by which these two brands are known and other trademarks and logos that depict or refer to or are directly associated with F&C Soccer Evolution Management football camps and Totti Academy are trademarks and logos of F&C Soccer Evolution Management football camps and Totti Academy. All rights in such trademarks and logos are expressly reserved and may not be used or reproduced without our express consent.

10.3 The Materials may not be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without Our express written consent. You may not systematically extract and/or re-utilise portions of the content of the Materials by any means, including the use of automated computer programs (including spider programs or other web crawlers), without Our express written consent.

10.4 All intellectual property and other rights in the form and content of our Camps belong to F&C Soccer Evolution Management, and no material or content in relation to any Camp may be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose.

 11. Data Protection

11.1 F&C Soccer Evolution Management undertakes to comply with its obligations under all applicable data protection and privacy laws and regulations, as applicable from time to time, which as at the date of these Terms and Conditions means the Data Protection Act 2018 and the GDPR (EU General Data Protection Regulation 2016/679) and any successor legislation ("Data Protection Legislation").

11.2 For further details on how F&C Soccer Evolution Management complies with the Data Protection Legislation please refer to Our Privacy Policy.

12. General

12.1 Certain laws require that certain information that F&C Soccer Evolution Management provides to you is in writing. You agree that most communications with F&C Soccer Evolution Management will be by electronic means (occasionally F&C Soccer Evolution Management may write to you by letter). F&C Soccer Evolution Management will contact you by e-mail or provide you with information. You agree to this electronic means of communication and acknowledge that contracts, notices, information and other communications that F&C Soccer Evolution Management provides electronically comply with legal requirements that such communications be in writing. For further information on notices, please refer to clauses 12.2 and 12.3.

12.2 All communications that You provide to F&C Soccer Evolution Management must be sent to F&C Soccer Evolution Management by e-mail to fecsoccerevolution.it@yahoo.com.

12.3 It is important that You keep the contact details held by F&C Soccer Evolution Management up to date. F&C Soccer Evolution Management may send a notice to You by e-mail to the addresses provided by You when reserving a place on a Camp. Notice shall be deemed to have been received and properly served immediately upon posting on the Website, 24 hours after an e-mail is sent. To prove the service of any notice, it shall be sufficient to prove that such e-mail was sent to the specified e-mail address of the addressee and was delivered to the addressee.

12.4 The parties agree with each other not to disclose or permit the disclosure of any confidential information relating to the business or affairs of the other party or the business or affairs of F&C Soccer Evolution Management other than to its employees, servants or contractors (if any) who are subject to appropriate non-disclosure undertakings (if any), or where the other party has consented to such disclosure or where it is required by law to make such disclosure. This clause shall not apply to information that is:

12.4.1 trivial or obvious;

12.4.2 already in the possession of a party, other than as a result of a breach of this clause; or

12.4.3 in the public domain, other than as a result of a breach of the applicable confidentiality undertaking.

12.5 The agreement between you and F&C Soccer Evolution Management is binding upon you and F&C Soccer Evolution Management and the respective successors and assigns of you and F&C Soccer Evolution Management. You may not transfer, assign, charge or otherwise dispose of this agreement, or any of your rights or obligations hereunder, without our prior written consent. F&C Soccer Evolution Management may transfer, assign, charge, sub-contract or otherwise dispose of this agreement, or any of our rights or obligations arising under it, at any time during its term, provided that the person to whom F&C Soccer Evolution Management transfers, assigns, charges, sub-contracts or otherwise disposes of this agreement or any of our rights or obligations arising under it agrees to abide by all of these Terms and Conditions for your benefit.

12.6 If F&C Soccer Evolution Management does not insist upon strict performance of any of your obligations, or if F&C Soccer Evolution Management does not exercise any of the rights or remedies to which F&C Soccer Evolution Management is entitled, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by F&C Soccer Evolution Management of any breach by you shall not constitute a waiver of any subsequent breach. No waiver by F&C Soccer Evolution Management of any of these Terms and Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

12.7 The parties agree that these Terms and Conditions are fair and reasonable in all circumstances. However, if any provision of these Terms and Conditions is held to be invalid by a court of competent jurisdiction, but would be valid if part of the wording were deleted, that provision shall apply with such deletions as are necessary to make it valid. In the event that any provision of these Terms and Conditions is held invalid, the remaining provisions of these Terms and Conditions shall remain in full force and effect.

12.8 F&C Soccer Evolution Management intends to rely on these Terms and Conditions and any document expressly referred to in them in relation to the subject matter of this agreement. Although F&C Soccer Evolution Management accepts responsibility for the representations and statements made by its duly authorised agents, please ensure that you seek written confirmation of any variations from these Terms and Conditions.

12.9 These Terms and Conditions and your Booking shall be governed by and construed in accordance with the laws of Italy and shall be subject to the exclusive jurisdiction of the Italian courts.
