MFA Membership - Assumption of Risk and Waiver of Claims

In consideration of this entry acceptance, I agree to the conditions of the rules and regulations of the Mamaroneck Frostbite  Association, all of which I shall have read before racing. I warrant and agree that my boat is seaworthy, complies with  Mamaroneck Frostbite Association specifications, and will be competently crewed and handled. I am fully knowledgeable of  the risks of sailing as a competitive sport.  
I agree that my own safety, the safety of my boat and the decision whether or not to participate in a race day, is my  responsibility and not that of any person sponsoring or undertaking these races and activities. I hereby agree to waive all  claims against Mamaroneck Frostbite Association, and its officers, directors, members, committees, employees, or agents,  arising out of or in any way connected with participation in any race days or related activities sponsored by Mamaroneck  Frostbite Association. I further agree that if, despite this Agreement, I, or anyone on my behalf, makes a claim against any of  Mamaroneck Frostbite Association, and its officers, directors, members, committees, employees, or agents, I will indemnify,  save, and hold harmless each of them from any loss, liability, damage, or cost, including, without limitation, any and all  litigation expenses and attorney fees, which any of them may incur as the result of such claim. I further agree to indemnify  and hold harmless the owner of any vessel I operate, if it is not my own, for any loss or damage to property, which may result  during my operation thereof, regardless of whether the harm is caused by me or another person, regardless of whether the harm  is the result of my negligence.  
If I have chartered a boat, I agree to surrender the chartered boat at the expiration of the racing season in the same or better  condition in which the chartered boat was chartered. Any repairs required to a boat I have chartered that are a result of racing  day activities, including but not limited to collision, capsize, and/or grounding, are my responsibility.  

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by  COVID-19 by participating or just being present and that such exposure may result in personal injury, permanent disability  or death. I understand the risk of becoming exposed to or infected by COVID-19 at MFA may result from the actions,  omissions or negligence of myself and others including employees, volunteers and participants. I voluntarily agree to  assume all of the forging risks and accept sole responsibility for any injury or illness and hereby release all Beach Point  Club and MFA members, officers, employees or agents from any claims resulting from COVID-19 whether a COVID-19  infection occurs before, during or after being present or participating at MFA.  

I have read , signed and submitted the waiver for Beach Point, Read and understand RRS 4 Decision to Race, and will abide  by the rules and understanding that MFA has set with the Beach Point Club.  

I agree that this waiver is binding on me, my heirs, representatives, successors and assigns. If any portion of this Agreement is  unenforceable, the remaining portions shall remain in full force and effect. This Agreement shall be construed and  interpreted according to the laws of the State of New York.
