Terms and Conditions
NO PURCHASE OR FEE IS REQUIRED TO ENTER/REGISTER.

1. Edit You 2.0 is the Intellectual Property of Pacific Group as Promoters: Pacific Mall Management.

2. Agreement to these Terms and Conditions: By participating in the free session, you the participant, confirms to have read and understood these Terms and Conditions and fully and unconditionally agrees to and accepts these Terms and Conditions

3. Eligibility: All participants must be 18 years or older at the time of entry, have full legal capacity and must be residents of India. Participant warrants that all information provided by participant in connection with this free session.

4. Competition Period: The Session starts at 0900 hrs Indian Standard Time (IST) on 8th May, 2022 and ends at 1100 hrs, IST, on 8 May, 2022.

5. How to Register Free: To enter the session participants must register via the link provided by the Promoter at the Venue, social media & at partner brand store.

6. Conditions: The Promoter will not be responsible for any lose or stolen item of your during or after session. The Promoter is under no obligation to pay or compensation if for any reason (including but not limited to force majeure). Promoter does not provide for any insurance, whether medical, cancellation or liability, in connection with this free fitness session.

8. Participant’s declaration: Participant agrees that for the promotion of event participant’s images/photographs may use on the on social media handles with name’s (i.e. first name and the first letter of the surname), place for promotional purposes or promotional activity without payment. This consent includes that Promoter may produce or have produced by a third party provider video recordings, audio recordings, pictures or other promotional material showing (“Material”) for the sole purposes of promotion of event and for marketing or similar business purposes.
8.1 Each participant of this Competition hereby agrees that Promoter obtains the exclusive, worldwide, irrevocable, royalty-free, unlimited in time right to:

8.2 Further, the participants declare that they have no underlying medical condition due to which participation in the Fitness session may not be recommended. The participants are at the time of making this declaration fully vaccinated against the COVID 19 virus, as recommended and provided for by the Government of India. Any violation of this section 8.2 shall be to the sole liability of the participant and the Promoter shall be kept indemnified and harmless in that regard.

9. Data Protection and Privacy: Personal data are any information concerning the personal or material circumstances of an identified or identifiable individual. All personal data are subject to specific protection, which will be ensured by Promoter through technical and organizational measures in accordance with applicable data protection laws.
During the course of the registration the following personal data will be collected: first and last name, email address and phone number. Winners will need to provide their email address, mobile number.
Responsible data controller for the collection, use and processing of participant’s personal data will be: Pacific Mall Management.

10. Limitation of Liability, Disclaimer: Except in the event of gross negligence or intent on the part of the Promoter or its agents, the Promoter does not accept responsibility for any lost, damaged, corrupted, delayed, quarantined, or not received by the Promoter, whatever the cause. The Promoter is not responsible or liable for any technical, hardware, software, server, website, or other, failures or damage of any kind. The Promoter shall not be liable for any loss or damage suffered by the participant on account of attending this session. By entering you agree to release and hold harmless Promoter and its, affiliated companies, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not.

11. Governing Law: THIS FITNESS SESSION IS GOVERNED BY THE LAWS OF INDIA and shall be subject to the jurisdiction of the courts of Delhi.

12. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between Pacific Mall management and the participant and the participant shall have no authority to bind Pacific Mall management in any manner whatsoever.

13. All rights, title and interest including but not limited to the Intellectual Property Rights in the promotional material(s) and any/all registrations received shall vest solely and exclusively with Pacific Group at all times and Pacific Group or  any other of the Pacific Group Companies, affiliates shall be entitled to use the activation, name, articles, database, material of the entries received or any information in any media for future promotional, marketing and publicity purpose without any further reference or payment or compensation to the participant of the session.

14. Participants shall be solely responsible for any consequences which may arise due to any kind of infringement of copyrights or any kind of Intellectual Property rights belonging to any other person/ entity etc. and also undertake to indemnify Pacific Group and its officers, directors, employees, etc. on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis

15. Each participant agrees that he/she has read and understood these terms and by their participation in the contest, each participant agrees to be bound by the terms. Mere participation should not be perceived as any commitment on the part of Pacific Mall management to offer a participant any sort of gift/money/compensation. Nothing herein amounts to a commitment by Pacific Group to conduct further, similar or other contests in future.

17. Pacific Mall Management reserves its rights to cancel, amend, suspend, withdraw, and/or reset the session/contest and the terms and conditions at any time without any prior notice.

18. The participation in the session as per the designated format will constitute the acceptance of these Terms and Conditions. Such acceptance by the participants shall be without any limitation.
