■講演内容：
新型コロナウイルス感染症蔓延の影響により、ブラジルは特許制度を大きく2つ改正した。1つ目の改正は、ブラジル特許制度の最大の特徴であるところの、ブラジル産業財産庁（INPI）と国家衛生監督庁（ANVISA：米国のFDAに相当）による医薬品特許出願の二重審査（事前承認）を取り消すもの。２つ目の改正は、国家緊急事態下における強制実施権に関する新しいルールである。後者については今回より具体的なルールが導入されたが、この立法過程においては強制実施権に関する興味深い議論が交わされた。本講演ではこの2点について詳細を吟味する。

In a reaction to the corona virus, Brazil has issued two big revisions to its patent system. The first revision involves the revocation of the most characteristic feature of the Brazilian patent system, which is the double examination (prior consent) of pharmaceutical patent applications by the INPI and Brazilian FDA (ANVISA). The second revision involves a new set of rules for compulsory licensing for situations of national emergency. The new revision brings more specific rules. However, the legislative process brought interesting discussions regarding the topic of compulsory licenses.

■講師略歴： カラペト・ホベルト氏は、リオ・デ・ジャネイロ州立大学（Universidade do Estado do Rio de Janeiro）法学部を卒業後、ブラジル国の弁護士資格を取得した。現在、ブラジルの法律事務所Licks Attorneysにパートナーとして所属しており、ブラジル及び南米における知的財産権に関する業務に10年以上携わってきた。日本の文部科学省の国費留学生として来日し、早稲田大学大学院法学研究科で修士課程および博士課程を修了した。現在、早稲田大学大学院法学研究科講師として、アジア・リージョン法LL.M.コース（Waseda LL.M. Asia Region）のアシスタントコーディネーターを務めている。

Roberto Carapeto graduated from the Faculty of Law of the State University of Rio de Janeiro (Universidade do Estado do Rio de Janeiro) and is admitted to the Brazilian Bar. Partner at Licks Attorneys, a Brazilian law firm. Roberto Carapeto has more than 10 years of experience in intellectual property in Brazil and South America. Received a Japanese Government Scholarship from the Japanese Ministry of Education, Culture, Sports, Science and Technology (MEXT) and completed his Master's and Doctoral studies at the Waseda University Graduate School of Law. Roberto Carapeto is currently working as a lecturer at the Waseda University Graduate School of Law, where he is the assistant coordinator of the LLM in Asian and Regional Law.
