WAIVER, AGREEMENT
& LIABILITY RELEASE
READ CAREFULLY BEFORE ACCEPTING
I agree to the following agreement with The Warm Springs Care Farm and the owners of 1311 E Warm Springs Avenue, Boise Idaho, as a condition for them following me, and person’s identified below, to enter the property, barn, and surrounding areas (Center’s Property) be near horses, ponies, or other animals (we will call them “equines”), receive experiential instruction or guidance, attend, participate in, or observe activities sponsored or conducted by the center, at any location and/or work with equines on, near, or off the Center’s property. All parts of this agreement shall apply to me. (We will call ourselves “I”, “me”, “we”’ or “my”’ as a group in this agreement.) We intend for this agreement to be binding at all times now and in the future, when Center permits us (directly or indirectly) to enter the Center’s Property, be near equines, receive experiential instruction or guidance, attend, participate in, or observe activities sponsored or conducted by the Center, at any location, and/or work with the equines on, or off the Center’s Property.
IT IS HEREBY AGREED AS FOLLOWS:
I have requested to do any and all of the following: enter the Center’s Property, be near equines, receive experiential instruction or guidance, attend, participate in, or observe activities sponsored or conducted by the center from professional counselors, independent contractors-instructors/trainers at any location, and/or work with equines on, near, or off the Center’s Property. Risks: I understand that anyone working with or near an equine at any location can suffer bodily and other injuries. Among other things, equines are unpredictable by nature. For example, when frightened, angry, or under stress, the natural instincts of an equine are to jump forward or sideways, or run away from danger by trotting or galloping. Equines are also known to kick, buck, or rear up, spin around, back up quickly strike, or bite. I know that equines can do any of these things without warning. I also understand that all equines, even if they have no history of injuring anyone, are powerful and could be dangerous to other people and other animals around them. Further, I understand that working with or being near an equine can expose me to numerous inherent risks, which could include, for example, the propensity of an equine to behave in a way that may result in injury or death to a person on or near it; the unpredictability of an equines reaction to sound, movement or unfamiliar object, person, or animal; a collision with an object or another animal; the potential for a person participating in an equine activity to act in negligent manner, to fail to control the equine, or to not act within his or her ability; natural hazards, including surface and subsurface conditions. I understand these risks and dangers are inherent in equine activities and release and discharge The Warm Springs Care Farm and the owners of 1311 E Warm Springs Avenue, Boise ID and it’s representatives, contractors, and their employees, agents, family members, heirs, assigns, affiliated persons, and others acting on their behalf of and from any and all claims, demands, damages, actions, omissions, suits, or causes of action (present or future), resulting from or arising out of my bodily injury or damage that may be sustained. I am voluntarily releasing all of these claims, as generally described above, against The Warm Springs Care Farm and the owners of 1311 E Warm Springs Ave, Boise Idaho, and it’s representatives, contractors, and their employees, agents, family members, heirs, assigns, affiliated persons, and others acting on their behalf regardless of whether the claims are known or unknown, anticipated or unanticipated. Miscellaneous: Idaho law governs this Waiver, Agreement, and Liability Release. This document can only be modified in writing and signed by me and The Warm Springs Care Farm and facility owners. Should any part of this document conflict with Idaho Law, only that part will be null and void and the rest shall stay in effect. Any disputes or activities arising under this Waiver, Agreement and Liability Release shall be litigated in a state or federal court nearest to Ada County, Idaho, and I agree to pay Center’s attorney fees and court costs.
