I/We agree that: In consideration of Lost Miner Ranch and Equestrian Center allowing my participation in this activity, I for myself and on behalf of my child and/or legal ward do agree does hereby release Lost Miner Ranch and Equestrian Center and their agents, representatives, members, owners of premises, roadways and trails and insurers and others acting on their behalf of this event from any liability arising out of my participation in the same, and does hereby agree to hold harmless and indemnify such individuals from any liability, whether intentionally or negligently caused, arising out of my participation in such event. This agreement shall extend to any rider of any horse participating of which I am the Owner/Exhibitor and to any person injured by such horse or rider. All activities will be conducted in a safe manner; and any animal or rider deemed to be unsafe, in the sole opinion of the event management, may be barred from participation in any class or from the show. I do further agree that I shall not bring any claims, demands, legal actions and causes of actions, against Lost Miner Ranch and Equestrian Center and its associates as stated above in this clause, for any economic or non-economic losses due to bodily injury and/or death and/or property damage, sustained by me and/or my minor child or legal ward in relation to the property, premises and operations of Lost Miner Ranch and Equestrian Center, to include while riding, handling, or otherwise being near horses owned by me or owned by other third parties, or owned by Lost Miner Ranch and Equestrian Center, or in the care, custody and/or control of Lost Miner Ranch and Equestrian Center, whether on or off the premises of Lost Miner Ranch and Equestrian Center, but not limited to being on Lost Miner Ranch and Equestrian Center premises. Each participant in an equestrian activity expressly assumes the risk of and legal responsibility for any injury, loss or damage to person or property which results from participation in an equestrian activity. Each participant shall have the sole individual responsibility for knowing the range of his or her own ability to manage, care for, and control a particular horse or perform a particular equestrian activity, and it shall be the duty of each participant to act within the limits of the participant's own ability, to maintain reasonable control of the particular horse or horses at all times while participating in an equestrian activity, to heed all posted warnings, to perform equestrian activities only in an area or in facilities designated by Lost Miner Ranch and Equestrian Center and to refrain from acting in a manner which may cause or contribute to the injury of anyone. It is statistically clear that there are certain inherent dangers associated with horseback riding. One of those dangers is the risk of suffering serious head injury should the rider fall or be thrown from his/her horse. It is, therefore, the policy of Lost Miner Ranch and it’s assigns, that safety riding helmets will be worn at all times when riders are mounted on a horse. I am fully aware of that policy and the reason for it, and chose of my own free will, NOT to wear a safety riding helmet. In taking this action, I hold Lost Miner Ranch, it’s assigns, and their insurer free of any liabilities for injuries that I may receive as a result of my actions and failure to wear a safety riding helmet. *
