BLACK GIRLS POLE CITIES NYC CHAPTER - EVENT LIABILITY WAIVER

Event Participation Waiver

I, the undersigned participant, acknowledge and agree to the following terms as a condition of my participation in the event organized by Black Girls Pole Cities NYC Chapter (hereinafter referred to as "the Organization"), taking place at a designated park area.

Assumption of Risk

I recognize that pole dancing involves physical exertion that may be strenuous and can cause physical injury. I am fully aware of the risks and hazards involved. I hereby agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which might incur as a result of participating in the event.

Liability Release

In consideration of being permitted to participate in the outdoor pole dance event, I knowingly, voluntarily, and expressly waive any claim I may have against the Organization, its officers, directors, employees, volunteers, and agents for injury or damages that I may sustain as a result of participating in the program.

Medical Acknowledgment

I attest that I am physically fit and have no medical condition that would prevent my full participation in the outdoor pole dance event. In the event of an emergency, I authorize the Organization to secure from any accredited hospital, clinic, and/or physician any treatment deemed necessary for my immediate care and agree that I will be responsible for payment of any and all medical services rendered.

Equipment and Safety Acknowledgment

I acknowledge that I will receive instruction on the proper use of pole dance equipment and agree to follow all safety instructions and guidelines provided by the event organizers. I understand that failure to follow these guidelines may increase my risk of injury. I agree to use the equipment only as intended and instructed.

Protection of Personal Property

I acknowledge that I am responsible for my personal property during the event. The Organization is not responsible for lost, stolen, or damaged personal property brought to or left at the event site.

Participant Conduct

I agree to conduct myself in a manner that is respectful to all participants, instructors, and staff during the event. I understand that the Organization reserves the right to dismiss any participant who exhibits behavior deemed disruptive or dangerous to themselves or others, without refund.

Compliance with Local Laws

I acknowledge that the event is held in a public space and agree to comply with all local laws and regulations, including but not limited to noise levels and public decency statutes.

Weather-Related Cancellations

I understand that the outdoor pole dance event is subject to weather conditions. In the case of inclement weather, the Organization reserves the right to cancel or postpone the event to ensure participant safety. I acknowledge that no refunds will be issued due to weather-related cancellations but an effort will be made to reschedule the event.

Media Release

I understand that during the course of the event, I may be photographed or videotaped. I hereby consent to the use of these photographs and/or videos without compensation, on the Organization's website or in any editorial, promotional, or advertising material produced and/or published by or on behalf of the Organization.

COVID-19 Agreement

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending the outdoor pole dance event, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I agree to follow all health and safety protocols set by the Organization, including but not limited to mask-wearing, social distancing, and sanitization procedures.

Acknowledgment of Understanding

I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
