COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread through person-to-person contact, including individuals without disease symptoms. As a result, federal, state and local governments and state agencies recommend social distancing and have, in many locations, prohibited or limited the congregation of people in groups.


The health and well-being of our staff and athletes remains a top priority. In order to minimize the risk of COVID-19 entering our environment and spreading amongst our community, we will only allow staff assigned to work and athletes scheduled to participate to be in our gym. Parents wishing to remain on site can use outdoor common areas or the parking lot to wait for their athlete(s). Athletes waiting to attend a session will need to wait outside while maintaining social distancing from others.


Furthermore, all participants in sponsored activities at OMNI VOLLEYBALL CLUB (OMNI SPORTS) must agree to and abide by the following:

Participants will notify OMNI SPORTS (OMNI VOLLEYBALL) immediately of any exposure to or possible infection by COVID- 19, including themselves, family members or recent contacts. This includes showing any symptoms (elevated temperature of above 100 degrees, cough, headache, shortness of breath, loss of taste or smell, or a positive COVID-19 test)'

Parents and participants agree they, their family members, and their known contacts have not shown symptoms within the last 10 days

Participants will follow all protocol put forth by OMNI SPORTS (OMNI VOLLEYBALL) or may be asked to leave

OMNI SPORTS (OMNI VOLLEYBALL) (hereafter referred to as the “Club”) has put in place numerous preventative measures and enhanced cleaning protocols to reduce the likelihood of spreading COVID-19 in Club’s training environment; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending sponsored activities at the Club could increase your risk and your child(ren)’s risk of contracting COVID-19.


By electronically signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily agree to the participation terms described above and assume the risk that my child(ren) and I may be expose to or infected by COVID-19 by attending Club activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death.


I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including but not limited to, Club employees, contractors, volunteers, and program participants and their families. I voluntarily agree to assume all the foregoing risks of and accept sole responsibility for any injury to my child(ren) or myself (including but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club, facility, or participation in Club programming (“Claims”).


On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, Board of Directors, officers, representatives and facilities, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.


I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, contractors, agents, Board of Directors, officers, representatives and facilities, whether a COVID-19 infection occurs before, during, or after participation in any Club or facility activity.

LIABILITY

I acknowledge that volleyball or any sporting event is an extreme test of a person’s physical and mental limits and that my participation or attendance in an event held at this facility can cause potential death, serious injury, or property damage. With a full understanding of the potential risks, I HEREBY ASSUME THE RISKS OF PARTICIPATING, OFFICIATING OR ATTENDING AN EVENT AT THE OMNI SPORTS FACILITIES.


I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns: a) I WAIVE, RELEASE, AND DISCHARGE from any and all claims or liabilities for death or personal injury or damages of any kind, EXCEPT THAT WHICH IS THE RESULT OF GROSS NEGLIGENCE AND/OR WANTON MISCONDUCT OF PERSONS OR ENTITIES LISTED BELOW, which arise out of or relate to my traveling to and from or my participation or attendance in any event held at the OMNI Sports facility, THE FOLLOWING PERSONS OR ENTITIES: OMNI SPORTS, OMNI VOLLEYBALL, Touch Shooting LLC, and the officers, directors, employees, contractors, representatives, and agents of any of the above; b) I AGREE NOT TO SUE any of the persons or entities listed above for any of the claims or liabilities that I have waived, released or discharged herein; and c) I INDEMNIFY AND HOLD HARMLESS the persons or entities mentioned above from any claims made or liabilities assessed against them as a result of my actions.


If applicant is under 18 years of age, a parent or guardian must execute, in addition to the foregoing Waiver and Release, the following, for and on behalf of the minor.


FACILITY CODE OF CONDUCT & POLICY



Possession, use or distribution of alcohol, tobacco, vaping devices or e-cigarettes is prohibited.

Physical damage to a facility or theft of items from a room, common area, court space or other person.

Possession of fireworks, ammunition, firearms, or other weapons or any item or material which by commonly accepted

practices and principles would be a hazard or harmful to other persons.

Any action considered to be an offense under Federal, State or local law ordinances.

Conduct which is inappropriate as determined by comparison to normally accepted behavior.

Physical, verbal or sexual harassment, intimidation or altercation with any individual.



Violation of the above can lead to immediate removal from the premises, law enforcement or legal action. OMNI SPORTS reserves the right of removal of any person(s) from the facility at any time.
