Volunteer Confidentiality Agreement
1. Background:

1.1 The Volunteer has agreed to participate in Learning in Reach’s volunteer activities, for civic, charitable, or humanitarian reasons, without promise, expectation or receipt of compensation for services rendered.

1.2 In the course of this participation, the Volunteer may gain access to data, materials, knowledge, and proprietary information generated through, originating from or having to do with the volunteer activities or with persons associated with the activities, including but not limited to Learning in Reach or its contractors, suppliers, directors, employees, beneficiaries and volunteers.

2. Learning in Reach’s Confidential Information:

2.1 Learning in Reach’s Confidential Information shall include, but not be limited to, documents, information, designs, printed matter, policies, procedures, supplier lists, beneficiary lists, donor information, contracts, financial data, fundraising data and materials, conversations, messages (received or transmitted), resources, contacts, e-mail lists, and e-mail messages, whether internally between Learning in Reach’s directors and/or employees and/or volunteers or between any of them and any third party.

2.2 The Volunteer agrees that no Confidential Information of Learning in Reach’s shall be used by him or her or disclosed to any party except as is expressly necessary for the performance of the Volunteer’s duties towards Learning in Reach.

2.3 The Volunteer agrees that all Learning in Reach’s Confidential Information is and shall remain the sole property of Learning in Reach, and that the Volunteer shall have no right or claim of any nature in or to the Confidential Information.

2.4 Any breach of the confidentiality of Learning in Reach’s Confidential Information is to be guarded against at all times, and the Volunteer agrees to take all steps that may be reasonably necessary to prevent Learning in Reach’s Confidential Information falling into the hands of an unauthorised third party. The Volunteer agrees to report any suspected breach to Learning in Reach immediately when same comes to his or her attention.

3. Beneficiaries’ Personal Information:

3.1 The Volunteer agrees to keep all Beneficiaries’ personal information, including all beneficiary file information, strictly confidential.

3.2 The Volunteer may only use or disclose Beneficiaries to the extent necessary for the execution of Learning in Reach’s authorised activities and within the bounds as consented to by the beneficiary concerned. Such personal information is not be used or retained by the Volunteer or disclosed to any third party.

3.3 Any breach of the confidentiality of beneficiaries’ personal information is to be guarded against at all times, and the Volunteer agrees to take all steps that may be reasonably necessary to prevent Beneficiaries’ personal information falling into the hands of an unauthorised third party. The Volunteer agrees to report any suspected breach to Learning in Reach immediately when same comes to his or her attention.

4. General:

4.1 The Volunteer’s undertakings in this agreement are irrevocable and shall remain in force indefinitely.

4.2 The Volunteer’s undertakings shall govern any and all Confidential Information and personal information which s/he gains access to through his or her volunteer activities for Learning in Reach, whether s/he gained access to it before or after his or her signature of this agreement.

4.3 Any data or documents or other materials which Learning in Reach gives to the Volunteer in relation to his or her voluntary activities will remain the property of the Learning in Reach and must be returned to the Learning in Reach forthwith upon request. The Volunteer may not make or retain copies of any such data, documents or other materials without the prior written consent of the Learning in Reach.
