Description: On May 6, 2020, the U.S. Department of Education, Office for Civil Rights (“OCR”) finalized new Title IX regulations, which went into effect on August 14, 2020. The changes in the law are significant and require all school districts to dramatically change their approach to sexual harassment investigations. Given the mandatory training requirements, the substantial changes to Title IX in these final regulations, this presentation by former OCR attorney Michael J. Joyce will provide a high-level overview of key provisions and takeaways for Superintendents, Student Services Directors, Title IX Coordinators, Principals and Assistant Principals. Please note that the new Title IX regulations have eliminated the single investigator model of sexual harassment claims and mandate training of all personnel involved in the investigation and/or resolution processing of such claims (e.g., Title IX Coordinator, investigator, decision-maker, informal resolution facilitator, and the appellate review personnel). This training is specifically designed to satisfy the OCR training requirements.
