​​1. To the best of my knowledge, I am in good physical condition and fully able to participate in cheerleading, pom, dance, and tumbling at Monash University Cheerleading Club (the Club). I understand that my position on a team is not guaranteed. I am fully aware of the risks and hazards involved in this activity, including physical injury and/or death, and hereby elect to voluntarily participate in said activities or events, knowing that the activity may be hazardous to me and my property. I will notify coaches of any current allergies, asthma, illnesses and injuries I am experiencing prior to commencing any and all training or tryout sessions run by the Club. I will immediately notify coaches of any physical harm or injury that either occurs or is sustained during any said activity or event run by the Club, so that appropriate medical assistance can be sought, and I agree to pay in full any fees or expenses incurred in providing such medical assistance.In the event that I suffer physical harm, injury, or other medical condition, I agree to receive first aid assessment and/or necessary treatment by Level 2 First Aid qualified coaches, committee members, or other appropriately qualified parties present. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OR LOSSES, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or loss of/damage to property owned by me, as a result of participating in activities run by the Club.

2. Without limiting any other clause in this document, I agree that a coach, committee member, or other representative of Monash Cheer and Dance may call an ambulance on my behalf, or request a third party to call an ambulance on my behalf, at their discretion. I agree that I will be liable for any associated ambulance fees or other costs, and that I am responsible for ensuring I am covered by ambulance insurance if I do not wish to bear these costs personally.

3. I give permission for a committee member or other representative of the Club to contact my 'emergency contact' nominated on this form if deemed necessary by a coach, committee member, first aid provider, or other representative. I give permission for my emergency contact to be provided with details of any injuries/conditions I may be suffering from, events and circumstances relating to my injury/condition, and any other relevant information.

4. I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE, Monash University Cheerleading Club, and Committee members of Monash University Cheerleading Club, the staff or employees or Monash University Cheerleading Club, or any other parents, athletes, coaches, coaching assistants, or any other person participating within Monash University Cheerleading Club, herein referred to as RELEASEES, from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any other property belonging to me, whether caused by negligence of the releasees, or otherwise, while participating in any Club activity, or which in, on, or upon the premises where an event, training or activity is being conducted or in transportation to and from said premises.

5. It is my express intent that this Release and Hold harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, shall be deemed as a RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the above named RELEASEES. I hereby further agree that this Waiver or Liability and Hold Harmless Agreement shall be contracted in accordance with the laws of the Sate of Victoria.

6. I understand that Monash University Cheerleading Club and Monash University produce promotional material relating to their programs. I understand that as a participant and/or spectator I may be included in videos and photographs taken during training, competitions, events, performances, or other activities. Therefore, without reservation or limitations, I, hereby assign, transfer, and grant to Monash University Cheerleading Club, its Committee, its successors, assignees, licensees, sponsors, employees, coaches and all commercial exhibitors the exclusive right to photograph and/or video myself  and to utilize such videos and photographs and name, face, likeness, voice, appearance, for Monash University Cheerleading Club, in advertising and promoting the program, in advertising future events, or in engaging non financial or financial sponsorship agreements. I further understand that neither Monash University Cheerleading Club, nor any third party, is under any obligation to exercise any of the foregoing rights, licenses and privileges. I waive any right to inspect or approve any material related thereto.

7. In signing this release, I acknowledge and represent that I HAVE READ THE FOREGOING Waiver of Liability and Hold Harmless Agreement, UNDERSTAND IT AND SIGN IT VOLUNTARILY and my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreements have been made, and I EXECUTE THIS RELEASE FOR FULL, ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND THE SAME.
