1.) I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Trapped Downtown employees. *

2.) I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Trapped Downtown for injury, loss or damage arising out of my or my family’s use of or presence upon the facilities of Trapped Downtown, whether caused by the fault of myself, my family, Trapped Downtown or other third parties. *

3.) I agree to indemnify and defend Trapped Downtown against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use of or presence upon the facilities of Trapped Downtown. *

4.) I agree to pay for all damages to the facilities of Trapped Downtown caused by me or my family’s negligent, reckless, or willful actions. *

5.) Any legal claim that may arise from participation in the above shall be resolved under Nebraska law. *

6.) I agree that Trapped Downtown has the right to any photos of me during the Trapped Downtown experience to be used for any marketing purposes. *

I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing.  I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire.  I further agree and acknowledge that Trapped Downtown has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement. *

8.)  SPECIAL STATEMENT REGARDING COVID–19: The novel coronavirus has been declared a worldwide pandemic by the World Health Organization. COVID–19 is extremely contagious and is believed to spread mainly from person-to-person contact.  Trapped Downtown has put in place preventative measures to reduce the spread of COVID-19; however, Trapped Downtown cannot guarantee that you and/or your minor(s) will not become infected with COVID-19. Further, visiting Trapped Downtown could increase your risk and/or your minor’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that myself and/or my minor(s) and I may be exposed to or infected by COVID-19 by visiting Trapped Downtown and that such exposure or infection may result in personal injury, illness, permanent disability, and death.  I voluntarily agree to assume all of the related risks and accept sole responsibility for any injury to myself and/or my minor(s). *
