COVID-19
In consideration of participation in Shawl-Anderson Modern Dance Center’s (SADC’s) Adult Program and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

SADC cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while utilizing SADC’s services or premises. It is not possible to prevent the presence of the disease. Therefore, if you choose to utilize SADC’s services and/or enter onto SADC’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

I am aware of the COVID-19 pandemic and related governmental orders, directives, and guidelines, including directives for frequent hand washing, social distancing, and use of FACE MASKS in public locations. I have read and understood the above warning concerning COVID-19 and risks involved. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my dependents in order to utilize SADC’s services and enter SADC’s premises. These services are of such value to me that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize SADC’s services and premises in person.

LOCATION
I willingly agree to participate in and understand that SADC’s offerings may be provided in one or more of the following locations:

--at 2704 Alcatraz Avenue, Berkeley, CA in the organization’s primary facility;

--online remotely and virtually where I participate from my home or a premises indoors or outdoors of my own choosing;

--in a outdoor setting to be established upon program registration and or selected by the SADC instructor or administrator if the original location is deemed unavailable;

AGREEMENT
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,

I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Shawl-Anderson Modern Dance Center, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I have voluntarily chosen to participate in dance and movement activities offered by SADC. I am aware that dance training and related activities carry certain risks that can result in injury, both minor and major and I am fully aware of the risks and hazards involved whether conducted IN-HOUSE, OUTDOORS or REMOTELY ONLINE from my home or another location of my choosing. I recognize that dancing requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

I further expressly agree that the foregoing liability waiver is intended to be as broad and inclusive as its permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the remainder of the agreement shall, notwithstanding, continue in full legal force and effect.

I have read the above Waiver of Liability and Indemnification Agreement and fully understand its contents. I voluntarily agree to the terms and conditions stated above. COMMUNITY STANDARD: SADC is a creative and welcoming community that believes in fostering the growth of each person involved and building community through movement. We value the experiences, learnings, contributions, and dignity of everyone in this community. SADC does not discriminate based on age, race, gender, size, disability, sexual orientation, gender identification, health, and other human attributes. We welcome the participation of all people in our community-based programs and offerings.

MEDICAL EMERGENCY: I give permission to SADC, its employees and staff, and its Board of Directors to seek medical treatment for me in case of serious emergency, injury, or illness, including call 9-1-1 for an ambulance if needed. I will provide SADC with an emergency telephone number upon registration.

SCENT FREE POLICY: We have many staff & students sensitive to perfumes, chemicals and scented body products. Please be considerate of our community by avoiding wearing scents of any kind when coming to the Center to dance, teach, visit or register for class.

USE OF IMAGE: I am aware that I may be photographed and/or videotaped, in connection with the activities of SADC. My name will not be associated with such image(s). I hereby give my permission and consent for my image(s) to be included in any photographs, brochures, posters, flyers, videos, marketing materials, website content, and any other documents. I release and hold harmless SADC from any and all damages, liabilities, and/or claims arising out of or relating to the usage of my image(s) in any such materials.

VALUABLES: All students should be aware that there is no place to lock up valuables at the Center. Students should bring all valuables into class with them instead of leaving them unattended in the dressing rooms. This includes wallets, purses, computers, phones, jewelry, expensive/desirable clothing and shoes, etc.

PAYMENT POLICY:  You must make a payment before beginning class. Please understand that we are a non-profit center and are unable to accept IOUs. Rates are subject to change. Credits and card extensions can be issued in case of emergency, injury, or illness for our regular drop-in classes.  Please contact us as soon as possible to discuss your situation. We are unable to credit or refund customers for workshops and master classes.

SUBSTITUTIONS/CANCELLATIONS:  However, we reserve the right to cancel or add classes throughout the year. Please visit our website to view the calendar for substitutions and cancellations.

LEVEL PLACEMENT: We request every student to select classes at the level appropriate for their training. We encourage you to observe classes, talk with instructors and inquire at the desk about what level and class will best meet your needs and interests. We support our teachers’ recommendations regarding class level. Teachers reserve the right to ask a student not to continue in a class if they feel it is creating an unsafe situation for you or other students (a refund would be provided). Dancing at the appropriate level helps ensure your safety and allows the teacher to plan suitable class material. ATTENDANCE & CLASS SIZE:  We strongly urge students to arrive early for class. Arriving on time allows students to warm up together, facilitating a safe and mutually respectful environment. No students will be admitted more than 15 minutes late. Teachers may set an earlier cut-off time at their discretion. Some of our classes have a size limit to promote safety and the quality of the class.
