RISK AND LIABILITY WAIVER SUBMISSION 

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19, Personal Injury, or Property Damage 

The novel coronavirus of 2019 (“COVID-19”) has been declared a worldwide pandemic by the World Health Organization. On March 12, 2020, Governor Steve Sisolak of the State of Nevada issued a Declaration of Emergency to facilitate the State’s response to the COVID-19 pandemic. On March 13, 2020, the office of the President of the United States declared a nationwide emergency pursuant to the Stafford Act. COVID-19, and any variant thereof, is extremely contagious. Immanuel’s Temple (the “IT”) and the PA Owens Christian Academy (the “Academy”), located at 2610 Fire Mesa Street, Las Vegas, Nevada 89128 (collectively the “Church”) has put in place preventative measures to reduce the spread of COVID- 19; however, the Church cannot guarantee that you will not be exposed to or become infected with COVID-19 or any variants thereof. Further, participation or volunteering in Church auxiliaries, groups, events, services, and activities (“Church Events”) could increase your risk of contracting COVID-19, and variants thereof, or other infectious diseases. 

READ CAREFULLY BEFORE SIGNING 

1. By signing this agreement, I acknowledge the contagious nature of COVID-19, any variants thereof, and other infectious diseases and voluntarily assume the risk that I may be exposed to or infected by COVID-19, any variants thereof, or other infectious disease by participation in the Church; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19, any variants thereof, and other infectious diseases while at the Church and/or participating in Church Events may result from the actions, omissions, or negligence of myself and others, including, without limitation, the Church’s employees, volunteers, and/or other participants and their families.
   
2. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, without limitation, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, or any kind, that I may experience or incur in connection with my presence at the Church and/or participation in Church Events. I hereby release, covenant not to sue, discharge, and hold harmless the Church, its employees, agents, representatives, and volunteers, of and from all claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto, including but not limited to exposure to COVID-19 and any variants thereof, slip- and-falls, medical emergencies, physical injuries, mental injuries, emotional injuries, negligence and any and all claims related thereto. I understanding and agree that this release includes and claims based on the actions, omissions, or negligence of the Church, its employees, agents, representatives, or volunteers, whether a COVID-19 infection or other infectious disease occurs before, during, or after be present at the Church and/or participating in Church Events. 
3. I represent that I have adequate insurance to cover any injury or illness I may suffer or cause while present at the Church and/or participating in Church Events, or else I agree to bear the costs of such injury or illness myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
   
4. By signing this document, I agree that if I am exposed to or infected by COVID-19, any variants thereof, or other infectious disease during my presence at the Church and/or participation in Church Events, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being release on the basis of any claim for negligence or otherwise.
   
5. By signing this document, I agree that if I experience any personal injury, property damage or loss during my presence at the Church and/or participation in Church Events, then I may be found by a court of law to have waived my right to maintain a lawsuit against the parties being release on the basis of any claim for negligence or otherwise, including but not limited to slip-and-falls, negligence and any and all claims related thereto, medical emergencies, physical injuries, mental injuries, and emotional injuries.
   
6. I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me or that the cost to engage in this activity would be significantly greater if I were to choose not to sign this release, and agree that the opportunity to participate at the stated cost in return for the execution of this release is a reasonable bargain. I have read and understood this document and I agree to be bound by its terms.
   
7. If I have signed a separate general release or waiver of liability connected with my presence at Church and/or participation in Church Events, I agree that the terms of that release or waiver are wholly incorporated into this document that the terms of this document are incorporated into the separate general release or waiver.
   
8. I agree that I will practice safe social distancing and clean hygiene during my presence at the Church and/or participation in the Church Events, in accordance with the Center for Disease Control and the Southern Nevada Health District.
   
9. I agree that this document constitutes the entire agreement between the parties with respect to the subject matter of this document, and this document supersedes all prior negotiations, understandings, and agreements between the parties, whether written or oral, with respect to the matters described in this document. Also, I understand this document contains all terms and conditions relating to the resolution of any and all claims between or among the parties. I understand that this document may not be changed, altered, modified, qualified or amended in any way except in a writing signed by all of the parties.
