HELQUIST BASKETBALL’S PARENTAL CONSENT, ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENTThe undersigned parent, guardian, or legal representative hereby consents to the participation of _____________________________________________ (Please Print Name of Child) in the Helquist Basketball League and Training and all its associated activities (the “Activity”) which is owned, operated, and managed by Helquist Basketball LLC (“Helquist”). For and in consideration of my child being allowed to participate in the Activity, and other valuable consideration, the sufficiency of which is hereby acknowledged, the undersigned parent, enters into this Consent, Assumption of Risk, Release and Waiver of Liability and Indemnity Agreement (“Agreement”) and agrees as follows:1. CONSENT AND WARRANTIES: I hereby consent to my child’s full participation in the Activity. I understand the nature of the Activity and warrant that my child is qualified, in good health and in proper physical condition to participate in the Activity, and I have not been otherwise informed by a healthcare provider that my child is incapable of participation in the Activity or any other similar activity.I represent and warrant that I have the legal capacity and authority to execute this Agreement and to release, indemnify and hold harmless Helquist, its owners, employees, independent contractors, agents, officers, members, attorneys, representatives, and contractors and, if applicable, owners and lessors of premises on which the Activity will take place (each considered one of the “Releasees” herein) against any claims made or threatened against them as more fully described in this Agreement.2. ACKNOWLEDGEMENTS: I fully understand and agree that:a) Participating in the Activity is a risky activity, and could potentially lead to serious illnesses (including the risk of contracting or spreading COVID-19) and injuries including, but not limited to temporary, permanent, partial or complete impairment in the use of my limbs, and possible permanent disfigurement, disability, brain damage, paralysis or even death (collectively the “Risks”).b) The Risks may be caused by my actions or inaction’s, the actions or inactions of others, including my child or another person’s child, the condition in which the Activity takes place, or the negligence of the "Releasees" named below.c) The Risks may include other social/non-economic and economic losses, either not known to me or not readily foreseeable at this time.3. ASSUMPTION OF THE RISK: I hereby acknowledge that I have been properly advised, cautioned and warned by Helquist that by participating in the Activity, I am exposing my child to the Risks. Having been so cautioned and warned, it is still my desire for my child participate in the Activity, and as consideration for such participation I HEREBY FULLY ACCEPT AND ASSUME ALL RISKS AND ALL RESPONSIBILITY OR PERSONAL INJURY, PROPERTY DAMAGE, DEATH, DISABILITY, LOSSES, COSTS, AND DAMAGES THAT I MAY INCUR AS A RESULT OF MY PARTICIPATION IN THE ACTIVITY,including by way of example and not limitation, any risk or liability that may arise from the sole or partial negligence on the part of any of these Releasees, from the exposure, infection and/or spread of COVID-19, from dangerous or defective equipment or property owned, maintained, or controlled by them, including the operation of the any such equipment, or because of their possible liability imposed by law without fault.4. RELEASE, WAIVER AND PROMISE NOT TO SUE: For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I for myself, my child, my heirs, executors, administrators, and assigns hereby release, discharge, waive and relinquish any and all actions, causes of action, claims and/or demands against Releasees for personal injury, property damage or loss to myself or my child, INCLUDING ANY SUCH INJURIES, LOSSES OR DAMAGES AS A RESULT OF CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE ACTIVE AND/OR PASSIVE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT ATTEMPTS TO RENDER MEDICAL TREATMENT TO ME OR MY CHILD, AND ANY INJURIES, LOSSES, OR DAMAGES AS A RESULT OF ANY EXPOSURE, INFECTION, AND/OR SPREAD OF COVID-19. I further release and waive any and all actions, causes of action, claims and/or demands against Releasees for litigation expenses, attorney fees and court costs, including those in bankruptcy cases or proceedings. I further agree that will not initiate legal action or arbitration of any type against Releasees for any claim or asserted claim arising from my participation in any Activity associated with Helquist.5. INDEMNIFICATION AND HOLD HARMLESS: I further agree that if anyone on my behalf, or my child’s behalf, makes a claim against any of the Releasees, I SHALL INDEMNIFY AND HOLD HARMLESS EACH OF THE RELEASEES from any and all liabilities or claims made, WHETHER CAUSED BY THE RELEASEES NEGLIGENCE OR OTHERWISE, and from any litigation expenses, attorney fees, loss, liability, damage, or court costs, including those in bankruptcy cases or proceedings, which Releasees may incur as the result of such claim.6. OTHER AGREEMENTS:a) I understand, acknowledge, and accept that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Florida and agree that if any portion hereof is invalid, the remainder will continue in full legal force and effect.b) I agree that this Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida, and venue for any legal proceeding or lawsuit shall be in Duval County, Florida.c) I agree that in the event that any clause or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement which shall continue to be enforceable.d) In signing this Agreement, I further acknowledge and represent that no oral representations, statements or inducements not contained herein have been made to me by any of the Releasees; that I am fully competent; and that I execute this Agreement fully intending to be bound by same. I further represent and declare that in executing this Agreement I relied solely on my own judgment, belief, and knowledge, and/or on the advice and recommendations of my own independently selected counsel.e) I further authorize any representative of HELQUIST to obtain any medical treatment for said child in the unlikely event of an injury or illness during any Activity, and I agree to pay any expenses incurred for such treatment.I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT MY CHILD AND I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I MUST SIGN THIS AGREEMENT AS A CONDITION TO BEING ALLOWED TO PARTICIPATE IN ANY OF HELQUIST’S EVENTS, FUNCTIONS, ACTIVITIES, OR TO ENTER HELQUIST’S PREMISES.By signing below, I express my understanding and intent to willingly and voluntarily enter into this Consent, Assumption of Risk, Release and Waiver of Liability and Indemnity Agreement.
