2020 Huntingdon Community Food Garden Waiver of Liability
We hope your gardening experience is safe and rewarding, but accidents can happen. The following waiver must be signed by all gardeners to protect ReInvision Huntingdon from liability.

The Huntingdon Community Food Garden, on behalf of ReInvision Huntingdon, is seeking businesses, organizations, and local schools that would like to be the primary caretakers, or "Garden Crew Members," of the Community Garden during the growing season (May-October).  The garden is located on the south-facing slope below the former William Smith Elementary School at the corner of 5th and Moore Streets.  Our produce has been donated to the Salvation Army, the Huntingdon Drop-In Center, Soup Kitchens, and taken home by dedicated volunteers.

Every member who is interested in volunteering must have the waiver completed PRIOR to their scheduled garden work session.

In the midst of a global pandemic and economic shutdown, we understand the importance of access to local food and garden space.  We therefore plan to be operational this season but will be enforcing strict guidelines to ensure that garden volunteers and personal gardeners maintain safe practices while at the garden.  Please visit our website for more information about our plans for 2020: https://reinvision.org/initiatives/community-food-garden/

Waiver: In consideration of being permitted to participate in any way in the Huntingdon Community Food Garden I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue ReInvision Huntingdon, Inc., or its officers, directors, volunteers and/or agents including Ryan Gibboney, Huntingdon Community Center or its officers, directors, volunteers and agents from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in the Huntingdon Community Food Garden. *

Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD ReInvision Huntingdon, Inc., or its officers, directors, volunteers and/or agents including Ryan Gibboney, Huntingdon Community Center or its officers, directors, volunteers and agents HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in the Community Garden and to reimburse them for any such expenses incurred. *
Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Pennsylvania that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. *
Photo Release: I authorize ReInvision Huntingdon, Inc. to use my or my child’s photo in any manner ReInvision Huntingdon, desires, for advertising, display, audio-visual, exhibition, and/or editorial use to promote the Huntingdon Community Food Garden initiative. *
Covid-19 Waiver: I agree to attend garden work sessions wearing personal protective gear, including a mask and gloves, and I agree to maintain a distance of 6 feet from other volunteers, in keeping with social distancing guidelines.  I also agree not to share tools or any other objects with others while at the garden.  I acknowledge that I understand that there are significant risks of being in public places, including the Community Garden, during this time of declared Emergency, and I hereby state that I fully understand the risk and assume the risk of being in a public place.  I also agree to follow all safety rules defined by the Community Garden Crew Leaders and will be asked to leave the gardens if not in compliance. *
Consumption: I understand that growing produce in a public setting comes with risks. By initialing, I indicate that I am aware and acknowledge that soil and food borne illness may be contracted through gardening and consuming undercooked or unwashed food. *
Parent or Guardian (if crew member is under 18): I am the parent or legal guardian of the above named minor child and, as such, I am authorized to enter into this agreement. I agree that my minor child and I are bound by and subject to the terms of this agreement. I understand that my signature here reflects my agreement to hereby release, waive, discharge, and covenant not to sue ReInvision Huntingdon, Inc., Huntingdon Community Center or its board of directors, volunteers and agents including Ryan Gibboney from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in the Huntingdon Community Food Garden.
