The world has seen the imposition of economic sanctions and financial penalties applied by one or more countries against a targeted state, group, or individuals. These instruments of foreign policy and economic pressure dealing with international trade and politics. Examples of recent sanctions such as those imposed by the US on Russian-occupied Crimea; EU sanctions against Chinese officials for alleged human rights abuses in China; China’s counter against a number of British individuals and entities. Arbitrators and counsel alike need to tread carefully to avoid getting caught up in such sanctions. Some academic writers have opined that, unless withdrawn, such sanctions continue against both entities as well as individuals who were members of barrister’s chambers on the day the sanctions were implemented. This session seeks to explore the views of international arbitration counsel and arbitrators as to how such sanctions can impact on enforcement of arbitral awards as well as the arbitration proceedings themselves.
