TERMS AND CONDITIONS

Contract for tours
Clients joining the tours shall conclude a tour contract with Oka Tours, a registered travel agency with Tokyo Metropolitan Governor’s Office (registration number: 2-5714) and make all payments to Oka Tours. The actual operation of the tour will be made by Boso Adventure Tours who are registered as a tour operator (Chiba No.60) and partnered with Oka Tours.

Reservation and payment
The client must submit the registration form. The tour contract shall become valid upon confirmation of the reservation. Payment should be made by cash to the guide before the start of the tour. Credit card payments in advance could be made and arranged.

Cancellation and refund
The client is at all times entitled to cancel the Travel Contract, but must pay Oka Tours a cancellation charge determined as follows:

Changes to the Itinerary
Oka Tours may, after conclusion of the Travel Contract, cancel the tour or revise its contents and services for any of the following reasons: natural calamity or disaster, weather conditions, civil unrest, suspension of services rendered by transport/accommodation facilities, provision of transportation not based on the original operational plan, governmental orders, or other circumstances beyond Oka Tour’s control. Oka Tours reserves the right to take necessary measures when safe, smooth tour operation in accordance with the itinerary is deemed impossible, or when there is valid reason to believe that the tour cannot continue. If the minimum number of participants is not met by 2 day before the scheduled date, the tour on that date may be canceled. Oka Tours shall notify the client of tour cancelation no later than 1 day prior to departure.

Special Compensation
The indemnity rules will follow that defined in “Rules of Special Indemnity” of the Standard General Conditions of Travel Agency Business.

Included in Trip Prices
The meal(s) specified in each itinerary unless stated otherwise. Transportation from and to pickup / drop off points (unless participation with own vehicle is chosen). Admissions to temples and shrines, special events including cultural and other activities as mentioned in each itinerary. English-speaking guide(s). Consumption tax.

Not included in Trip Prices
transportation to and from pickup / drop-off point, insurance, alcoholic beverages, private taxi, telephone and any other expenses of a personal nature.


RELEASE, ACKNOWLEDGEMENT OF RISK AND INDEMNIFICATION AGREEMENT

I acknowledge that there is a significant element of known and unanticipated risk in any adventure, sport or activity associated with the outdoors which could result in physical or emotional injury, damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without undermining the
essential qualities of the activity. Knowing the inherent risks, dangers and rigors involved in these activities, I certify that I am fully capable of participating in the activities. I voluntarily assume all risks and agree not to hold Oka Tours responsible for injury, death or economic loss resulting from any activity associated with participation in the tour. I certify that I have my own insurance appropriate to my needs and the needs of my family or dependants in respect of loss, injury, death or damage I may cause to suffer while participating. I further certify that I do not have any physical condition or disability that would create a hazard for me or other travelers.
As a tour operator, Oka Tours organizes, promotes, and sells tour programs consisting of certain travel services,
including surface and water transportation, sightseeing excursions, and cruise/barge/hotel accommodations that Oka Tours purchases or reserves from various suppliers (collectively, 'Suppliers'). Oka Tours does not own or operate any of these Suppliers. The Suppliers providing travel services for Oka Tours tour programs are independent contractors, and are not agents or employees of Oka Tours. As such, Oka Tours is not responsible for any negligent or willful act or failure to act of any supplier or of any third party. By utilizing the travel services of the Suppliers, I agree that I will look to such Suppliers for any accident, injury, property damage, or personal loss to me or to those traveling with me, and that neither Oka Tours nor any representative of Oka Tours shall be liable.
