This Agreement is between Rachel George and the person whose named on this document, who is referred to as “Participant”.  By filling out this form the Participant agrees to the following terms.

     The online classes, in person classes, workshops and all instruction facilitated by Rachel George and Rachel George are separate and independent from each other and from Suhaila Salimpour, Salimpour School and Salimpour Institute.  
     Participant represents that they are in good physical condition and that does not suffer from any disability, condition or limitation that would prevent or limit the participation in the workshop or class.  
     Participant understands that physical activity,
including but not limited to dance instruction and the activities involved in the workshop, involves a potential for risk of physical injury and related damages including, but not limited to, heart attacks, muscle strains, pulls or tears, broken bones, shin splints, heat prostration, knee/lower back/ankle or foot injuries.
     Participant personally and expressly agrees to assume all risks in connection with her/his participation in the workshop.
     Participant, for herself, her heirs, successors and assigns, understands and guarantees that neither Rachel George, www.RachelBellyDance.com, nor her subsidiaries, affiliates, employers, employees, agents, instructors, subcontractors, representatives, insurers, lenders, officers, TAs, directors, members, partners, heirs, successors, assigns and authorized guests, Suhaila Salimpour, Salimpour Institute, Salimpour School, Suhaila International will not be held liable in any way for any occurrence in connection with any injury, death of other damages to participant or her family or heirs and PARTICIPANT HEREBY RELEASES AND DISCHARGES FOREVER SAID PARTIES FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM PARTICIPATION IN THE WORKSHOP OR CLASS whether or not occasioned by the acts of negligence or failure to act of any of the aforementioned persons and whether or not the risk was foreseeable or unforeseeable.
     Participants further waives as to all such parties all claims and demands arising out of or in connection with the use of photographs, film or tape which may feature participant as otherwise provided herein, including but not limited to, any claims for defamation or invasion of privacy.
     Rachel George may film the aforementioned workshop, class or seminar.  I consent to photography/videotaping (both sound and images) and its release, publication, exhibition or reproduction to be used on Rachel George websites, telecasts, advertising or any other purpose.  I waive all rights I may have to any claims for payment or royalties in connection with any exhibition, televising or publication of these materials.
     I release Rachel George, her officers, TAs, Suhaila Salimpour, Salimpour Institute, Salimpour School, Suhaila International, employees, and each and all persons involved from any liability connected with the taking, recording, or publication of said images, videotapes or sound recordings.
     I also waive any right to inspect or approve any photo, video or film taken by Rachel George, her officers and employees.  
     All negatives and positives, weather prints, video, film, or sound recordings are the property of Rachel George, solely and completely.
     Participant hereby grants to Rachel George the absolute and irrevocable right and permission, with respect to photographs, film or tape or other images of participant that may be taken during the workshop.  (a) To copyright the same in its name or any other name that Rachel George may choose; (b) To use, re-use, publish or re-publish the same in whole or in part, individually or in conjunction with other photographs or images, in any medium and for any
purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade; and (c) To use participant’s name in connection therewith if it so chooses.
     The parties agree that any disputes of any kind arising out of or relating to the workshop or classes shall be settled by arbitration in accordance with the rules of the Judicial Arbitration and Mediation Service in San Diego California if the workshop is in the United States.  If the workshop is at an international location disputes or any kind shall be settled by mediation or arbitration in accordance with the rules of the American Arbitration Association. The arbitrator shall apply the substantive law of the State of California to the resolution of the dispute.
     The prevailing party shall be entitled to
reimbursement of attorney fees, costs, and expenses incurred in connection with the arbitration. All decisions of the arbitrator shall be final, binding and conclusive on all parties.  Judgment may be entered upon any such decision in accordance with applicable law in any court having jurisdiction thereof.  If any provision of this agreement is ruled invalid or unenforceable as to any person or circumstance, all other provisions of this agreement shall remain valid and enforceable as applies to all other persons or circumstances.
     Participant hereby represents and warrants that they are of legal age and legally competent to sign this Agreement; that they understands it and agrees the terms herein are legally binding and not a mere recital; that they have fully informed herself of the contents of this agreement by reading it before they signed it, and that they signs this document of her own free will.
     
     Participant agrees that by signing this form they will be added to Rachel’s mailing list.  Participant’s personal information will not be used for anything other than dance class related notifications and related information.  Participant can unsubscribe at any time.
     
Rachel George reserves the right to refuse service and/or participation of a Participant for any workshop and or class. Participant agrees there are no refunds.
