RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND PHOTO/VIDEO CONSENT (“AGREEMENT”)

1.) In consideration of being permitted in any way in the Physical Activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions are unsafe, I will immediately discontinue further participation in the Activity.

2.) I fully understand that: (a) Physical Activities involve risks of minor injuries and dangers of serious bodily injury, including permanent disability, paralysis, and death (“Risks”); (b) these Risks and dangers may be caused by my own actions or inaction’s, the actions or inaction’s of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the “Releasees” named below; (c) there may be other risk and social and economic losses either not known to me or not readily foreseeable at this time; and that I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Activity.

3.) By inputting the information requested,, checking the box below and clicking the "I agree" button, I understand, acknowledge and agree that I hereby release, discharge, and covenant not to sue Premier Basketball & Fitness Training (PBFT), Logan Ryan, nor the facility that is hosting the Physical Activity, their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, or any sponsors, advertisers, and if applicable, owner and lessors of premises on which the Activity takes place, (each considered one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “Releasees” or otherwise, including negligent rescue operations and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.

COVID-19 Waiver

PLEASE READ!!!!

The following COVID-19 Waiver has been added to our existing waiver at Premier Basketball & Fitness Training.

You must agree to and follow its current rules as well as any future modified and/or amended Rules. Failure to adhere to these Rules will result in dismissal from participation.

No person who is feeling ill, has a fever or exhibits any of the symptoms of COVID-19 should participate in the Physical Activities. Based on currently available information and clinical expertise, individuals of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. Anyone who wishes to participate in the Physical Activities should be familiar with the information set forth on the CDC website and should carefully consider whether it is advisable to come participate.

By inputting the information requested,, checking the box below and clicking the "I agree" button, I understand, acknowledge and agree that : (i) I will immediately notify PBFT if I contract the COVID-19 virus and specifically authorize PBFT to disclose such information to all of PBFT employees, Members and/or third persons that may have come into contact with me at the Physical Activity session and further authorize the use or disclosure of my health information for the purpose listed, (ii) the released information may no longer be protected by state and/or federal privacy regulations, (iii) I have the right to receive a copy of this Form, and (iv) I am signing this Form voluntarily.

Access to PBFT Physical Activity sessions shall be restricted for anyone who contracts the COVID-19 virus and may be restricted for individuals who came into contact with anyone with the COVID-19 virus until reinstated by PBFT in writing.

Throughout the course of today’s and future Premier Basketball & Fitness Training events, photographs and or videos may be taken of activities to be used to promote future events. I give Premier Basketball & Fitness Training, its representatives, employees, and volunteers the right to take photographs and or videos of myself and/or my family members, and authorize them to use this content in print and or electronically. *
