Ropes Course Release and Indemnity Agreement 2022-2023
       The Cooperative Middle School Challenge Course Program provides goal-oriented experiential opportunities for participants to explore new behaviors related to trust, group dynamics and leadership skills.  These activities may include games, problem solving initiatives, and experiential activities taking place in the field, the woods, or in the classroom, low elements constructed of rope, cable, and/or wood, and high elements, which require specialized safety equipment.  The Cooperative Middle School and SAU 16 have taken precautions to provide proper equipment, qualified instructors, and a carefully designed program.  A challenge course manager who has been trained in nationally approved standard operating procedures of challenge courses will supervise all program activities and will train and monitor all Cooperative Middle School staff members who will be assisting in delivery of programming.  Students will receive instruction related to all elements and program activities.

        Challenge course activities (indoor and outdoor) can be exciting, challenging and physically and emotionally demanding.  Some activities may be stressful and have inherent risks.  Even with qualified staff and proper preparation, it is impossible to guarantee absolute safety.  While it is the aim and responsibility of the Cooperative Middle School and its employees to provide participants with a positive and safe experience, there is a degree of risk and personal responsibility for safety when participating in challenge course activities.  

         Our philosophy is Challenge by Choice, which means that participants agree to choose their own level of challenge and agree not to be coerced by others to go beyond their physical or emotional limitations.  Furthermore, while some activities are physically demanding, our programs are designed to be inclusive and can be modified to allow all students to participate at a level that matches their interest and capability in a safe, respectful and supportive environment.    
     
        As previously stated, even with adherence to high industry standards of operation, the risk of injury or disability cannot be completely eliminated.  By consenting to your child’s participation, you assume all risks related to use of the course including the possibility of bruises, abrasions, sprains, insect bites and other more serious injuries up to and including death and other harm.  Signing this form indicates your recognition and understanding of the responsibilities and risks inherent in your child’s participation.

1 - Understand your child’s responsibility as a participant, that extent of participation is voluntary and that your child is free to discontinue or modify participation at any time before or during the activity;

2 - Have disclosed medical or other restrictions that would affect your child’s participation;

3 - Acknowledge that ERCSD does not maintain insurance against accidental injury for the benefit of the student and certify that the student’s medical expenses are covered by a medical insurance policy, or if not, accept absolute financial responsibility for such in the event that such expenses are incurred;

4 - Release and covenant not to sue ERCSD, and all ERCSD’s officers, agents, and employees, for a claim, of any kind, in any way related to or as a result of the student’s participation in the activity, whether the injury results from the alleged negligence or other tortious act of ERCSD or any ERCSD officers, agents, or employees, excepting only injuries suffered as a result of an act of an ERCSD employee which was intended to cause injury to the student; and agree to indemnify ERCSD and ERCSD officers, agents, and employees against and hold ERCSD and all ERCSD officers, agents and employees harmless from any and all claims of any kind made by the student or any other person in any way arising out of the student’s participation in the activity whether resulting from the alleged negligence or other tortious act of ERCSD and or ERCSD officers, agents or employees excepting only injuries suffered as a result of any act of an ERCSD employee which was intended to cause injury to the Student or the other injury which is the basis of the claim.

5 - Know that there are risks involved in a challenge course program and assume all of the risks of participating in the challenge course program.



ADDENDUM:  Eastern Equine Encephalitis (EEE) and West Nile Virus
       In the fall, we often receive reports of local mosquito populations testing positive for Eastern Equine Encephalitis (EEE) and West Nile Virus.  Our athletic fields are sprayed to help control the threat of mosquitos and all sports and PE programs will continue as planned.  Spraying is not an effective method for mosquito control in the woods where our challenge course is located.  To minimize the threat to our students, we will provide bug spray, dispensed under adult supervision to students as they enter the ropes course.  If you or your child does not want to use bug spray, or if you prefer an alternative method of mosquito prevention, they may refuse.  We encourage all students to wear long sleeves, pants, and a hat to minimize exposure to mosquitos and other insects.  Additionally, we will exercise good judgment and reschedule or cancel programming on days when the mosquito count appears especially high and we deem the environment to be unsafe.

        If you choose not to sign, your child will remain inside with an alternate activity or will participate in activities in the fields during the weeks leading up to the first hard frost of the fall, at which point the threat of mosquitos no longer exists and they will be allowed full access to the challenge course.

       By signing this portion of the form, I acknowledge that I understand the risks of EEE, West Nile Virus, and prevention strategies available to minimize the threat of mosquito bites. I give my child permission to participate in activities taking place in the woods during times of the year when there is an increased threat of mosquito-transmitted diseases.

Although you are signing this form at the beginning of the school year, your child may be participating in a challenge course program at any point during the 2022 – 2023 school year.  This Release and Indemnity Agreement applies to and will be valid for all challenge course activities in which the Student participates during the July 2022 – June 2023 school year.   It is your child’s responsibility to communicate to you which particular day(s) they will be participating in a challenge course program.
