Darlington Art Market 2020 Terms and Conditions to Trade

Thank you for trading at Darlington Market, we look forward to welcoming you to trade. Stallholders are advised to carefully read the following terms and conditions of stall hire prior to completing their application. They should also retain the copy of the terms and conditions for their future reference and guidance.  
Completion of an Application Form does not guarantee attendance at the event.
All bookings are accepted on the understanding that stallholders operate solely at their own risk. All traders are responsible for complying with all relevant trading legislation, compliance and CE certification associated with their brand and products.

OPENING HOURS:
The event will run from 10am - 4pm
BOOKING
Applications will be notified of acceptance upon application being submitted and accepted.
In order to ensure a balance of goods on offer the organisers reserve the right to limit the number of stalls selling each type of goods, so please ensure that you describe your proposed wares fully and fairly.
We cannot guarantee that regular traders will be designated their usual stalls. Please note: stallholders are NOT permitted to privately re-sell their stall pitch. Any change in stallholder details needs the prior written consent of The Darlington Markets.                                                                                                                                                                                        
When your booking has been confirmed you will be sent an acceptance letter and information relating to the set-up and de-rigging schedules.

HEALTH AND SAFETY:
You are required to ensure that you have all the appropriate certification for inspection during the event.  Health and Safety Regulations apply in respect of stall usage and you are responsible for safe conduct of your business and anyone connected with it.  Health and Safety checks will be conducted throughout the day.  If there is a serious concern which cannot be immediately resolved, you will need to discontinue trading in order to resolve the issue. Exhibitors must understand and comply with all current Health and Safety regulations, particularly with respect to equipment and public safety.

INSURANCE:
All stallholders must hold Public and Products Liability Insurance to the value of £5,000,000. Copies of insurance certificates should be submitted in advance of the event to alexandra.nicholson@darlingtonmarket.co.uk , and should be clearly displayed on the stall for the duration of the event.
The organiser does not and will not accept responsibility for any exhibitor loss, damage or financial loss as a result of the abandonment or cancellation of the event due to severe weather conditions or other factors beyond our control.

PAYMENT SCHEDULE:
Upon confirmation of your place, we require a 40% deposit due within one week of acceptance in order to reserve your place. This deposit is non-refundable except in exceptional circumstances which will be decided at the discretion of the Market Manager.

An i-zettle payment link will be sent to pay for the event pitch.

MAM does not accept responsibility for any exhibitor loss or financial loss due to the abandonment or cancellation of the event due to severe weather conditions or other factors beyond our control. If the event is cancelled due to severe weather alternative trading dates will be offered.

ELECTRICAL EQUIPMENT:
All electrical equipment used at the event must be PAT tested and carry a current PAT certificate. This is a statutory requirement of the Electricity at Work Regulations 1989. Copies of these certificates should be kept on the stall at all times. Exhibitors whose appliances are not PAT tested and/or are considered unsafe will be asked to remove the appliances.

TRADING STANDARDS
We are working with colleagues in Darlington Council to ensure that all traders comply with relevant legislation, CE certification and trading standards. If you are unsure if any of your goods do not comply or you have any questions please contact us before coming to the event – a question is better than a prosecution.

SALE OF ALCOHOL
Any exhibitor wishing to sell alcohol may do so, but they must apply for a Temporary Event Notice with Darlington Borough Council. If you wish to procure a TEN, please advise us so we can give you the relevant information.

BANNED PRODUCTS
The following are strictly PROHIBITED on the Darlington Markets site:
Selling and displaying of flags
Selling and displaying of toy guns
Selling or displaying of pornographic materials
Selling and displaying of counterfeit goods
Selling silly string or air horns
Selling of explosives or fireworks
Selling of anything that can be used as a weapon
Laser pens

STALLS AND EQUIPMENT
Stallholders will be provided with a trestle indoors or a stall which will include a full gazebo with weights, side, back and front sheets outdoors.  You are required to provide your own internal display equipment i.e. stands etc (tables are available to hire).

If using and erecting your own gazebo, this must be festival standard, constructed and adequately anchored down. A suitable risk assessment to cover the erection, dismantling, use and anchoring of the marquee/gazebo/stall/tent should be compiled together with assessments of fire risk and means of escape in case of fire or hazard. These documents should be available from supplier and made available to all members of the organisers team for reference. The person carrying out the erection should follow the manufacturers’ advice, guidelines and recommendations for the anchoring of the marquee/gazebo. All anchor points and ropes should be in good condition and fit for purpose and be regularly checked by a competent person while the structure is erected; if the weather changes/deteriorates the number of checks should be increased. The amount of ballast required should be obtained from the manufacturer and positioned and fixed in accordance with their instructions.
Stalls must be manned at all times during the event. All traders must ensure the safety of everyone who is associated with their stand and those persons who may be affected by the activities carried out therein.

POWER
There will NOT be a power supply.

WASTE AND RECYCLING
All traders will be expected to manage and dispose of their waste responsibly.  

DAMAGES AND LIABILITIES
Any damage caused by any stallholder, their employees, agents or any other person under their direction to the venue or its fixtures and fittings shall be immediately made at the stallholder’s expense.

All stallholders shall indemnify Darlington Markets against all liabilities, actions, costs, claims and compensation for injury, loss or damage to any person or property arising as a result of their trading at their event or any act, omission or negligence done or omitted by the stallholder, their employees, agents or any other person under their direction.

LOCATION
All pitches are pedestrianized and close to major retail outlets and shopping centres.  They will be allocated on a first-come first-served basis. The Darlington Markets carefully plan the layout of each event and trader, the location of a pitch is non-negotiable.

APPEARANCE OF THE STAND
The co-operation of all exhibitors is required to achieve an optimal appearance of their stands. Exhibitors should bring skirts, tablecloths etc to hide any material below the table line. Extra shelving, tables and lighting etc will display your merchandise to best effect. The Darlington Market reserves the right to withdraw products for sale that are not stated on the application form or to close the stall down. In the event of a stall being shut down due to failure to comply with T&C’s, no refund will be given.
                                                                                                                                                                           
PHOTOGRAPHY AND PUBLICITY
By accepting a stall all traders agree to being photographed by Darlington Market staff for future publicity purposes for the Darlington Markets and third-party partners.  
                   
REFUNDS
Your deposit to trade is non-refundable and secures your pitch for the event(s).
If you cannot attend due to unforeseen circumstances, you will be offered an alternative trading day but are not entitled to a refund. All refunds will be at the discretion of Market Management.

VEHICLES
All vehicles must be off the market by 9.45am each morning.
Vehicles must not re-enter the market until the end of trading or when the markets officer decides.

LATE ARRIVALS
Latecomers will not be allowed on site in vehicles after or before designated set up times. Stallholders may carry equipment on site manually if they arrive late but vehicles will not gain access. Latecomers will not receive a refund if they choose not to attend.

CANCELLATION
The markets will only be cancelled in the event of high winds.  The markets will still go ahead in the case of rain and snow.
