This Exhibitor Agreement ("Agreement") is entered into between
the Exhibitor and Makers Market & Events Center LLC ("MM&EC")
as of the date of the signed contract and payment receipt.
By signing this Agreement, the Exhibitor agrees to the following terms and
conditions:
1. Reservation: A reservation is confirmed upon receipt of payment and
the signed contract.
2. Use of Space: The Exhibitor understands that this Agreement does not
constitute a lease but grants the Exhibitor permission to use the designated
space solely for the duration of the event.
3. Tax Responsibilities: The Exhibitor is solely responsible for
complying with all Pennsylvania sales tax requirements. For more information,
the Exhibitor can contact the PA Dept. of Revenue at 1-888-PATAXES or visit
www.revenue.state.pa.us.
4. Outside Booth Requirements: Most Exhibitor spaces are approximately
24' x 11'. The Exhibitor must provide their own tables, , chairs, tent,
extension cords, surge protectors, and any other necessary equipment, unless
previously arranged. All tables must have fitted tablecloths, and the booth
area should be organized and presentable. No electricity outside. The Exhibitor can
visit the venue on Mondays or Wednesdays to view the available numbered spaces
from 1-149. Unmarked grass spaces of approximately 30' x 12' are also
available. Please note that an exact space number is not guaranteed.
5. Vehicle Parking: Vehicles must be parked within the
designated booth area and cannot leave during the event. Customer parking is
strictly for customers and not for exhibitors. Emergency lanes must be kept
clear at all times.
6. Tent Safety: All tents must be properly weighed down to ensure
stability and safety.
7. Event Commitment: Exhibitors are expected to commit to
the full day of the event. Early tear down or late setup is not permitted without
prior permission. Exhibitors who break down their exhibit early will forfeit
the opportunity to participate in future events. Events will be held rain or
shine. Vehicle traffic will be restricted after the setup time. If additional
availability is needed, please contact us for further arrangements.
8. Setup Time: 1 pm on Thursdays and Fridays and 9 am on
Saturdays. All setups must be completed by 2 pm on Thursdays and Fridays and 10
am on Saturdays.
9. Merchandise Placement: Exhibitors must confine their merchandise
within their designated space, respecting neighboring booths and public
lanes/hallways.
10. . Outdoor Exhibitor Smoking Policy: We
politely ask smokers to be mindful of the comfort of both Exhibitors and
customers in the outdoor area. Smoking is strictly prohibited inside the
building and the exhibitor area. To accommodate smokers, designated smoking
areas have been provided, and we kindly request that cigarette butts be
disposed of properly in the designated receptacles
11. Alcohol and Drugs: No alcohol, drugs, or drug paraphernalia are
permitted on the premises.
12. Animals: Only service animals with proper service jackets are
allowed on the property, and they must be always leashed.
13. Supervision of Minors: Exhibitors are responsible for ensuring that
all minor children (under 18) accompanying them are always accompanied and
under direct supervision.
14. Subletting and Loaning: Exhibitors are not permitted to sublet or
loan their booths to other parties.
15. Prohibited Items: The sale of counterfeit, pirated, bootlegs, stolen
goods, or unowned copyrighted items is strictly prohibited. MM&EC will not
be held responsible for any such items being sold.
16. Exhibitor Conduct: Exhibitors are expected to exercise good judgment
in case of any problems or disputes that may arise.
17. Noise and Behavior: Exhibitors must not engage in unreasonable
noise, disruptive behavior, or abusive conduct that may disturb other
exhibitors or event attendees.
18. Refund and Credit Policy: Reservations are non-refundable. However,
credit may be issued for outside booths if MM&EC is notified at least 7
days prior to the scheduled agreement dates.
19. Cleanup Responsibility: All outside booth spaces must be cleared of
waste and merchandise within one hour after the end of the rental period.
20. Right to Close Exhibit: MM&EC reserves the right to close an
exhibit at any time if the Exhibitor fails to perform, observe, or comply with
any terms set forth in this contract.
21. Risk of
Loss, Insurance, and Indemnification:
Certificate of
Insurance
Accepted Vendors must provide a Certificate of
Insurance with a minimum of $1,000,000 general liability coverage naming both Makers
Market & Events Center LLC and Bam Bam Investments LLC as additionally
insured. Certificates must be submitted with the completed application.

a. Exhibitor assumes
the sole risk of loss, theft, or damage to merchandise and other personal
property belonging to the Exhibitor while such property or merchandise is in
the Exhibitor's space or on the Flea Market premises or being stored by the
management as provided below.
b. Exhibitor
acknowledges that neither the management nor the owner of the Flea Market
building assumes any responsibility to ensure the safety or protect the Exhibitor's
merchandise from loss or damage caused by fire, rain, theft, malicious
mischief, accident, or any other cause.
c. The Exhibitor
acknowledges that they have been advised to purchase insurance to protect
against these and other losses. Exhibitor agrees to indemnify and hold the
management and the owner of the Flea Market, as well as their partners,
directors, officers, shareholders, managers, employees, and agents, harmless
from any liability, damage, cost, or expense (including reasonable attorneys'
fees and court costs) arising from (a) the Exhibitor's use of or activities in
or around the Exhibitor's space(s) or the Flea Market premises and/or (b)
injury to persons or property resulting from any cause whatsoever, including,
but not limited to, any furniture or fixtures in the Exhibitor's space, or from
merchandise, other property, or other items sold or exchanged by the Exhibitor.
Exhibitor assumes full responsibility for all merchandise the Exhibitor offers
for sale. Please see management if interested in purchasing insurance for your
booth.
22. Rent Policy:
- Booth spaces are rented daily. Discounts may be available for multiple days.
23. Check Policy:
- Booth spaces can be paid by cash, check, or credit card at the Makers Market
Office or through www.MakersMarketPA.com
Book a Space, or invoice. Checks must be made payable to Makers Market &
Events Center LLC. In the event of a returned check, all future rent payments
must be made in cash, and a $30 fee will be charged for bounced checks.

your artwork/logo for promotional purposes. Incomplete applications will not be
accepted. Please send an email if you do not wish to have your items or
pictures of your area or of you on social media or on our website, By not notifying
us you agree to use of photo taken and photos you provide.
