INHERENT RISK: In applying for membership at the facilities of the Woodstock Athletic Club, I acknowledge and understand that injuries are a common and ordinary occurrence of my participation in athletics and sporting activities, due to the inherent risks in these activities. I understand my participation in the activities and use of the Woodstock Athletic Club involves inherent and non-inherent risks which may result in property damage, injury and/or death. TO THE FULLEST EXTENT ALLOWED BY LAW, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF PROPERTY DAMAGE, INJURY OR DEATH that might be associated with, arise from or be obvious and necessary to my participation in such activities and my use of the Woodstock Athletic Club.

ASSUMPTION OF RISK, RELEASE OF LIABILITY AND COVENANT NOT TO SUE: To the fullest extent allowed by law, I hereby COVENANT NOT TO SUE AND RELEASE The Woodstock Resort Corporation dba the Woodstock Athletic Club and its agents, owners, employees, volunteers, directors, officers and shareholders and affiliated companies ("Released Parties"), from ANY AND ALL RESPONSIBILITY OR LEGAL LIABILITY for any and all claims asserted by anyone arising out of any injuries, damages or death I may suffer, whether caused by NEGLIGENCE or any other cause. I further agree that neither I nor my estate, heirs or assigns WILL EVER SUE the Released Parties, and that WE WILL DEFEND AND INDEMNIFY the Released Parties if any claim or action is pursued by anyone arising out of any injuries, damages or death to me that has any connection whatsoever to any activities involving the use of the Woodstock Athletic Club. I understand that this release extends to all claims arising out of or connected with, but not limited to, the following:
1. Any pre-existing health or medical problems or conditions of the applicant.
2. Conduct of other persons, whether employees of the Woodstock Inn & Resort.
3. Misuse of the Resort's equipment and facilities.

THIS IS A CONTRACT which provides a COMPREHENSIVE RELEASE OF LIABILITY to the greatest extent allowed by law, but it is not intended to assert any claims or defenses that are prohibited by law. If any of this document is deemed unenforceable, all other portions shall be given full force and effect. ALL CLAIMS arising

from any activities I participate at the Woodstock Athletic Club including for PROPERTY DAMAGE, INJURY AND/OR DEATH, shall be governed by the law of Vermont and I agree and understand that the exclusive jurisdiction for any claim or lawsuit I may bring related in any way to this Agreement of use of The Woodstock Athletic Club shall be brought only in the state or federal court of Windsor County, Vermont.

PHOTO RELEASE I agree to let Woodstock Athletic Club take, use, and publish photographs of players enrolled in our programs for marketing purposes.

Unattended Property: I agree that The Woodstock Inn and The Woodstock Athletic Club are not responsible for damaged or stolen property left unattended on its property.

CHILDREN AT THE CLUB: Children under the age of 13 years must be accompanied and supervised by an adult (age 21 years or older) while at the Woodstock Athletic Club. The areas of the Club permitting children under the age of 13 years do not include the Club's Strength & Cardiovascular area due to the presence of machinery and equipment not suitable for children. Additionally, children 10 years or younger are not permitted in the whirlpool at any time for their safety.
