By the execution of this agreement, my guests and I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and my guests and I hereby fully and forever release and discharge MSK Community Center, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of facilities and equipment.

My guests and I understand that the training, programs, and events held by MSK Community Center may put me and my guests at risk for accidents, injury, illness, or death. My guests and I understand that there are risks inherent in any physical activity, including but not limited to falls and injuries sustained as a result of contact with other participants. My guests & I assume all responsibility for such risks.

My guests and I understand it is our responsibility to communicate any physical or psychological concerns that may prevent me from taking part in an activity. My guests and I confirm that we are physically and mentally able to perform every chosen activity.

As I have read this waiver and acknowledge these facts, in exchange for the services that MSK Community Center will provide during our participation, my guests and I agree to waive any responsibility or liability from MSK Community Center, its officers, employees, agents, representatives, and organizers. This includes anyone entitled to act on my behalf arising out of my involvement in the training programs and/or events at MSK Community Center.

My guests and I understand and agree that MSK Community Center is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

I have read and understood this Waiver of Liability. I am aware that by agreeing to its terms; my guests and I waive any legal claims which might arise from our participation.

Consent Regarding Photographs, Digital Images, Audio Recordings, and Video Recordings

In consideration for MSK Community Center, the participant (or the participant’s parent/guardian if the participant is a minor) hereby provides consent for MSKCC to take photographs, make audio recordings, and make video recordings of the participant at the MSKCC. The participant (or the participant’s parent/guardian if the participant is a minor) understands that the photographs, digital images, audio recordings, and video recordings may be used by MSKCC in print or electronic media and that the photographs, digital images, audio recordings, and video recordings may be displayed on websites owned and/or sponsored by MSKCC. The participant (or the participant’s parent/guardian if the participant is a minor) gives the MSKCC permission to publish, exhibit, and distribute the photographs, digital images, audio recordings, and video recordings. The participant (or the participant’s parent/guardian if the participant is a minor) understands that MSKCC owns the copyright to the photographs, digital images, audio recordings, and video recordings in which the participant may appear. The consent of the participant (or the participant’s parent/guardian if the participant is a minor) is acknowledged by the signature(s) set forth below.
