Waiver of Liability (Minor) 2024

BY SIGNING THIS DOCUMENT YOU GIVE UP LEGAL RIGHTS.

In consideration of this minor being allowed to participate in the Two Row on The Grand/Deyohahage Gihę’gowahneh taking place at various locations between Cambridge and Lake Erie in Canada, including but not limited to kayaking, canoeing, hiking, swimming, camping and riding in vehicles, and any portion of the trip en route from July 23 to August 2, 2024, I understand, acknowledge and agree to the following:

They have complied with all Ontario protocols for CoVid19.

I will make sure that they follow all CoVid19 protocols required by the province and any further precautions advised by the Two Row organizers and Ground Crew.

They have adequate physical and mental health for this adventure and I have truthfully and completely filled out the medical information page.

I fully understand and acknowledge that by their participation in these activities and/or use of equipment supplied to us, serious risks and dangers may exist in their participation; their participation in such activity may result in their injury or illness including risks for but not limited to bodily injury, strains, eye injury, blindness, property damage, water inhalation, choking, or drowning; these risks and dangers may be caused by the negligence of the staff, volunteers, officers or agents of the event as well as spectators; the negligence of the participants, the negligence of others, accidents, breaches of contract, or other causes; and these risks and dangers may arise from foreseeable or unforeseeable causes.

I understand that kayaking, canoeing, hiking, swimming, camping and riding in vehicles are activities that involve inherent hazards associated with the dynamic and unpredictable environment and may result from forces of nature, equipment failure, negligence, and/or willful, intentional misconduct of the participants or leaders. Participants can be injured walking or climbing along the shore, getting into or out of boats, and while paddling. I recognize that not all hazards can be foreseen or controlled and this is not an exclusive or exhaustive list of possible ways to become injured. Their participation may result in physical injury, or even death. Neither the Two Row on The Grand/ Deyohahage Gihę’gowahneh nor the cooperating sponsors and agencies have control of all the risks involved.

On behalf of myself, my personal representatives and/or my heirs, I hereby voluntarily agree that none of the staff, volunteers, officers, employees, representatives, consultants and/or agents of the Two Row on The Grand/ Deyohahage Gihę’gowahneh, its cooperating sponsors and agencies, and owners and lessors of premises used to conduct the symbolic enactment (collectively, the "Releasees") shall be responsible in whole or in part for any loss, damage or injury to this young person or their property of any nature howsoever caused including without limitation the following: their death, any bodily injury they may suffer no matter how small or how large including strains of any kind to their body, eye injury they may suffer including blindness, or bodily damage they may suffer including through water inhalation, choking, or any damage to or loss of their personal property, or any communicable disease and I hereby release and discharge the Releasees from all claims, demands, damages, losses or injury of any kind or nature, grievances and actions in any manner whatsoever, whether expressed or implied, and whether in law or in equity, arising by reason of or resulting from their participation in this event including from any of the foregoing matters stated in this paragraph, and this shall be so even though the Releasees or any one of them have in some way been negligent including in the doing of any act or the failing to do any act, or in any of their conduct.

By signing below I agree: (1) to assume all risks and dangers associated with their participating in this event including the above noted risks, (2) to assume all responsibility for any losses and/or damages to them, whether caused in whole or in part by the negligence of staff, volunteers, officers or agents of the Two Row on The Grand/Deyohahage Gihę’gowahneh, other participants or by any other person and (3) that the Releasees (as that term is defined herein) or anyone else will not be supervising their participation in this event (even though they may appear to be supervising and as a result I will not rely completely on anything that may appear to be supervision or instructions that they may give to me).

I hereby give permission for their image to be taken in photos/videos during activities for the Two Row on The Grand/Deyohahage Gihę’gowahneh and cooperating sponsors and agencies to use said images in non-commercial publicity. This release will also acknowledge my consent to the use without any compensation to me, by the Two Row on The Grand/Deyohahage Gihę’gowahneh, event organizers, media and other organizations associated with the event, their name and image in connection with this event including the event website.

The organizers reserve the right to accept or reject any paddlers’ registration for any reason. They also reserve the right to rescind the eligibility of any registrant at any time due to the registrant's use of any mind altering substance or their communication which demonstrates, in the minds of the organizers, that the registrant is not using the Good Mind, as defined in the orientations on the first, and fifth days of the paddle. If, after the registrant has been warned about their behaviour, they continue that behaviour, they will be asked to leave on their own accord, by our own arrangements. No refund will be issued.
