This waiver applies to all events/practices/gym/tournaments/matches held at the Area 11 Facility (owned by Eleven E Cricket Inc.) located at 50 Borden Ave S (Unit 3), Kitchener, ON or at any branch of Eleven E Cricket Inc. or organized by Eleven E Cricket Inc. but held at any other location.

In consideration of being allowed to participate – I, the undersigned hereby,

● Agrees that prior to participating, if present, I will inspect the facilities and equipment. If I believe anything to be unsafe, I will immediately advise the management of Area 11.

● Understand and acknowledge that my participation in activities at Area 11 involves inherent risks, including but not limited to the risk of injury and/or death. I am aware that sports activities can be physically demanding and may involve sudden and unexpected movements, collisions, and other risks not present in everyday life.

● Acknowledges and fully understands that I am voluntarily participating in activities that involve known and unknown risks of injury, including catastrophic injury, permanent disability, and/or death, which might result not only from my own actions, inactions, or negligence but the actions, inactions, or negligence of others, including but not limited to Area 11, the rules of play, the conditions of the premises, or any of the equipment used.

● In consideration of being allowed to participate in these activities, I, for myself, my heirs, executors, administrators, and assigns, do hereby release, discharge and hold harmless Area 11 facility, its officers, directors, employees, agents, and volunteers from any and all claims, demands, actions, or causes of action, whether presently known or unknown, arising out of my participation in these activities.

● Assumes all the foregoing risks as a condition of participation and accepts personal responsibility for the damages following any such injury.

● Unconditionally releases, waives, indemnifies, and holds harmless and consents not to sue the officers, directors, administrators, agents, coaches, other employees, volunteers, sponsoring agencies, sponsors, and advertisers of Area 11.

● I accept responsibility for all medical expenses incurred whether or not covered by insurance. In case of emergency, accident, or illness, authorizes ambulance transport to the hospital. I authorize physicians, athletic trainers, technicians, first-aid personnel, nurses, and dentists to perform any diagnostic, treatment, or operative procedures and x-rays. No guarantee has been given as to the results of examination or treatment. I accept total responsibility for any and all medical costs.

● I accept responsibility for the decision to continue participation if suffering from injuries.

● I acknowledge that Area 11 is not responsible for any personal items or property that are lost, damaged, or stolen at the facility.

● I understand that I am responsible for any damage to the facility or property caused by my willful misconduct, negligence, or intentional acts and I agree to cover any costs associated with repairs or replacement.

● I have read and voluntarily signed this liability waiver and release of claims and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.

● I hereby release, waive, discharge, and covenant not to sue Area 11. its owners, officers, employees, agents, and representatives (hereinafter collectively referred to as the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury to my vehicle or its contents, whether caused by the negligence of the Released Parties or otherwise. I agree to indemnify and hold the Released Parties harmless from any and all liabilities, costs, expenses, claims, and demands, including legal fees, arising out of or related to my use of the parking facilities at the Facility.

● I understand that I am permitted to park my vehicle only in the designated parking area specified by Area 11. I agree to park my vehicle only in the designated space and comply with all posted signs and instructions regarding parking regulations.

● I have read this Liability Waiver, fully understand its terms and conditions, and acknowledge that I am giving up substantial rights, including my right to sue the Released Parties. I acknowledge that I am signing this waiver freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
