COMMISSION TOS(revised 5/31/23 to better account for generative art, derivative works, and machine learning technologies)
By ordering a commission, you are declaring that you are of legal age and agreeing to these Terms of Use.
I reserve the right not to accept, to refund any remaining balance, or to terminate your commission at any time.
These Terms may update at any time; updates will NOT retroactively influence older orders. Older orders will be held to the Terms present at the time of ordering.
--- ORDERING AND CREATION---
I accept PayPal (USD) only, and I will expect payment or invoice the client once the commission is accepted and the quote is agreed-upon and finalized. Unless otherwise agreed upon, clients will have one week to pay an invoice before it is cancelled. Please do not send me money in advance - anything I've not yet formally accepted will be returned.
Partial refunds can be requested at any time before completion and these refunds will adjust based on the work I've completed and the work I've yet to do; full refunds will only be issued before the start of any work.
Please provide clear and concise visual references, or indicate where your references aren't entirely accurate.
There will generally be at least one revision/sketch stage; if there aren't (in sketch commissions, artist's choice, etc), then exceptions will be stated in the commission type. I will no longer accept adjustments after the base color stage.
Submission of this form does not guarantee a commission slot, and the order of form acceptance does not necessarily guarantee the order of completion. Please respect my schedule and working hours; I am raising an infant, I pull freelance jobs and work regular office hours. If anything arises such as work, emergencies, or health issues that may delay the commission in a significant manner, I will notify the client as soon as I am able. Deadlines must be clearly communicated before the quote and point in which the commission is accepted, and will generally affect the price and be addressed on a case-by-case basis.
All commissions will be digital art unless otherwise noted.
--- USAGE ---
These commissions are for personal use only. As a rule, clients shall NOT use commissions commercially or in any other manner that would invite profit, licensure or royalties; this includes the minting of NFTs. However, if one does wish to use the commission commercially, to change or adjust the commissioned works through the use of machine learning or derived technologies (AI art), or create derivatives of the commissioned works through the use of machine learning or derived technologies, this could remain an option and will be discussed on an individual basis - please expect legal contracts and industry rates and inquire about the exact fee for your commission in advance.
I will not claim any rights to the characters or intellectual properties commissioned, and you as the commissioner are declaring you own the IP or have been granted permission for usage of the character.
I as the artist retain all rights to created artwork, and reserve the right to display commissions on my sites, in physical form, or in my portfolio. Clients can re-post art as long as proper and thorough credit is given.
By filling in this form, you are agreeing to the above TOS.
