Liability Waiver
Liability Waiver - In consideration of my child participating in activities at Kids U, I agree to assume all risk and hereby waive, and release Kids U, LLC and its officers, directors, employees and instructors (collectively "Kids U") from any and all claims or causes of action for injury, damage or loss to the person or property of my child.  I further agree to indemnify and hold Kids U harmless from any and all losses, claims or causes of action for injury, damage or loss in any way relating to or arising from any incidents occurring at its facility.  This waiver and release is intended to be an express waiver and release from any and all claims against Kids U arising from my child's participation in any activities, including all claims or causes of action based upon the alleged negligence or gross negligence of Kids U.  This agreement shall remain in effect as long as and whenever my child participates in activities at Kids U.  I also grant Kids U permission to provide emergency assistance and obtain medical care in the event of a medical emergency.  Further, in consideration of my child's participation in Kids U activities, I grant Kids U the right to use and copyright photographs of my child taken at Kids U (but not his or her name) in Kids U print and electronic advertisements. *

COVID-19 WAIVER
COVID-19 Waiver -                                                                                  I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.  I further acknowledge that Kids U Port Chester, LLC has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19 but cannot guarantee that my child(ren) will not become infected with the Coronavirus/Covid-19.  I voluntarily seek services provided by Kids U Port Chester LLC and acknowledge that I am increasing my child(ren)'s risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while participating in activities at Kids U.I will inform Kids U staff if my child(ren):* experience any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.* I believe someone in my immediate family has been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.I hereby voluntarily agree to waive, hold harmless Kids U Port Chester LLC and Kids U LLC and its officers, directors and employees from any and all claims, demands, damages and causes of action of any nature whatsoever which I, my heirs, my assigns or successors may have against them for, on account of, or by reason of my child(ren)'s participation in the above activities. I indicate my agreement to this hold harmless elective noted below. It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES. This Agreement and the provisions contained herein shall be construed, interpreted, and controlled according to the laws of the State of New York. *
