The novel coronavirus, COVID-19, has been declared a global pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Industry City (herein the “Organizer”) takes the novel coronavirus pandemic very seriously and has put in place preventative measures intended to reduce the spread of COVID-19. By accepting this Waiver and Release of Liability, you agree to comply with and abide by all preventive measures, rules and procedures established by Organizer and the reasonable requests of Organizer’s staff that are reasonably intended to reduce the spread of COVID-19.

Despite these preventative measures, Organizer cannot guarantee that you, your family or others with whom you have close contact will not become infected with COVID-19 as a result of attending the Organizer’s group fitness event at the Industry City campus (herein the “Activity”). Given the nature of group events, you may come into close physical contact with Organizer staff, independent contractors, vendors, guests and others and may involve the use of shared objects, equipment, products and supplies, all of which increase the risk that you, your family members, and/or others with whom you have close contact may be exposed to or contract COVID-19.

You acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you, your family members and others with whom you have close contact may be exposed to or infected by COVID-19 as a result of attending the Activity; that such exposure or infection could result in personal injury, illness, permanent disability, and/or death; and that such exposure or infection may be caused by the actions, omissions, or negligence of yourself or others, including, but not limited to, Organizer staff, independent contractors, vendors, guests or others.

By accepting, you waive, release, covenant not to sue, discharge, and hold harmless Organizer and Industry City’s ownership entities (including but not limited to 1-10 BUSH TERMINAL OWNER LP, 19-20 BUSH TERMINAL OWNER LP, and JAMESTOWN COMMERCIAL MANAGEMENT COMPANY, L.P.), and their owners, staff, agents, affiliates, employees and independent contractors (collectively the “Indemnified Parties”), from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to receiving any Client service or services or attending the Activity. You understand and agree this waiver and release includes any claims based on the actions, omissions, or negligence of the Indemnified Parties, their staff, independent contractors, clients, guests or others.
