All American Sitters Agency and Client Event Childcare Contract

This Contract ("Agreement") is made and entered into on today’s date by and between:

All American Sitters, with its principal place of business at 6339 Charlotte Pike, Nashville, TN 37209 (referred to as the "Agency"),

And:

1. Engagement:

a. Special Instructions or Requests:

This document serves as confirmation that All American Sitters shall provide its exceptional childcare services for your forthcoming event. We express our enthusiasm in being part of this significant occasion.

• Safety Standards and Pre-Event Visit:

Our commitment to safety includes a comprehensive site visit prior to the event to ensure compliance with our rigorous safety standards. We collaborate closely with your event team to meet all your requirements,we conduct a thorough site visit before the event. This ensures that the location meets our stringent safety standards. 

• Minimum Four-Hour Duration:

To provide the exceptional care we are known for, we request a minimum event duration of four hours. If your event is less than this four-hour duration, the Client will still be responsible for paying the four-hour minimum.

• Snacks, Food, and Drinks:

Please ensure that snacks, food, and drinks are readily available for both the children and our sitters. This ensures everyone stays happy and energized throughout the event.

• Bring Along Familiar Comforts:

For an enhanced experience for your young ones, we encourage you to bring their cherished toys, books, or games. Familiar items often contribute to a smooth and joyful transition for the children.

2. Services Provided:

a. Activity Oversight and Specialized Event Childcare Specialists:

• Our dedicated team consists of highly trained childcare specialists, each carefully selected to ensure the safety and enjoyment of your young guests. These specialists meticulously plan and supervise all activities, guaranteeing a secure and delightful experience for every child attending your event.

c. Military and Veterans Discount:

• Active Military and Veterans are entitled to an exclusive 10% discount on their wedding childcare booking, available year-round, as a token of our appreciation for their service.

d. Optional Add-Ons:

• Clients have the option to enhance the event experience with customizable add-ons, available for a nominal fee.

3. Compensation:

a. Total Fee and Invoice Details:

• The comprehensive fee for our distinguished childcare services is explicitly delineated in Attachment Schedule Fee Form, accompanied by the corresponding invoice. This transparency guarantees clarity and provides you with a precise comprehension of the investment in the triumph of your event.

b. Securing Our Services:

• In order to reserve our committed team for your event, we respectfully request that 50% of the total payment be remitted one month prior to the event date. The final payment is to be made two weeks before the event. This protocol enables us to conclude all essential preparations and ensures seamless operations on the event day.

c. Additional Hours, Additional Care:

• If your event extends beyond the initially stipulated duration, please be assured that any extra hours of service will be invoiced separately. We are dedicated to accommodating your requirements and guaranteeing the well-being of the little ones, irrespective of the event's duration.

4. Cancellation Policy:

a. Cancellation 2 Weeks or More Before the Event:

• In the event that it becomes necessary to cancel the event two weeks or more prior to the scheduled date, a 50% refund will be promptly issued. We recognize that unforeseen circumstances may arise, and we stand ready to assist you.

b. Cancellation Within 10 Days of the Event:

• Cancellation is required within 10 days of the event date, the full payment of the total fee shall be applicable. This policy is instituted to ensure that our team is duly compensated for the time and effort invested in the preparation for your event.

5. Insurance:

a. Coverage Assurance:

• All American Sitters hereby confirms the maintenance of comprehensive general liability insurance, providing coverage for all aspects of childcare services during events.

b. Client Liability:

• The Client accepts full responsibility for any injuries or damages occurring at the event venue. All American Sitters take all necessary precautions to ensure the safety and well-being of the children, as well as the smooth operation of services during the event.

6. Confidentiality:

a. Confidentiality Commitment:

• Both parties, the Agency and the Client, commit to maintaining strict confidentiality regarding sensitive information. This encompasses the preservation of client details and the impressive qualifications of our exceptional sitters.

b. Legal Compliance for Candidate Information:

• The Client understands and agrees to abide by all legal obligations regarding the confidentiality of Candidate information. This includes using such information solely in conjunction with All American Sitters' Staffing Firm.

c. Safeguarding Integrity and Interests:

• This clause is implemented to ensure the integrity of our referral process and to safeguard the interests of all parties involved.

7. Social Media:

a. Definition of Social Media:

• For the purposes of this clause, "social media" refers to mobile and web-based applications facilitating user-generated content, communication, and social interaction. This encompasses, but is not limited to, platforms such as blogs, online communities, discussion forums, review sites, Instagram, Twitter, Facebook, LinkedIn, Snapchat, Youtube, Tiktok, Pinterest, and any other related or similar websites.

b. Guidelines for Sitters:

• Sitters are expressly prohibited from sharing photographs of employer's children, job terms, or client private property without explicit consent from the employer. Additionally, sitters are strongly advised against engaging in inappropriate social media activities, posting unauthorized photos, or participating in any form of slander that may directly harm or affect themselves, the client, children, or anything claimed to be unlawful.

c. Client and Sitter Engagement:

• Both Clients and Sitters are encouraged to share positive feedback, recount positive experiences, and refer The Agency to potential Clients and Placements. For further details, please contact The Agency to discuss the terms and arrangements.

8. Governing Law:

• To uphold absolute clarity and fairness for all parties involved, this Agreement is governed by the laws of Tennessee. This choice of governing law establishes a robust foundation for our working relationship and provides a clear framework for any potential legal considerations

• a. Comprehensive Understanding:

• This Agreement serves as the definitive representation of our complete understanding as we embark on this collaborative venture. It stands as the cornerstone of our partnership, superseding any preceding agreements or understandings.

b. Foundation for Collaboration:

This commitment to a clear and comprehensive understanding lays the foundation for a successful and harmonious working relationship.

10. Amendments:

a. Careful Consideration of Changes:

• In the event that amendments or modifications to this Agreement become necessary, rest assured that we will approach them with the utmost care and attention to detail.

b. Formalized Changes:

• All amendments will be formalized in writing and necessitate the signatures of both parties. This ensures that any alterations made are executed with the full consent and understanding of all involved.
